    Everest Technology? Sounds so familiar, but definitely they are not in the list of blood suckers I dealt with.
    There are thousands of bloodsuckers like this one, they know the Immigration law better than anybody else do, they will do anything to stop you from leaving their company.

    BTW, you don�t need the copy of I-140 for using AC21 portability.
    You might need a copy when you apply for a 3 years H1 extension, double check this with an attorney.

    If I were you, I wouldn�t stick with this employer, I would definitely use AC21 after 180 days.

    Thanks Sheela. Was that visit to home, a part of your employer audit as well as it was mentioned by bujjigadu123 or something else?
    Not sure whether you got a chance to ask the officer about the reason for this visit? Was it a part of random check or any investigation on fund transfers or any other program etc?

    Now, I think it is a random check and nothing like 'employer audit'. I never asked him -at that time I thought it was a part of background check.

    I believe they are always doing these checks probability could be 1/100,000 although i have no idea at the frequency.

    It is an irony that most people here who raised valid concerns have "red" reputation. I sort of agree that we should have posting guideline and if some body is contributing it does not give them right to bash others. All this extra push, inappropriate language and finger pointing is hurting IV in the long run. One reason of IV's popularity is xxxxx members (80 % free riders even if). I agree that this forum is also to discuss your immigration issues.

    Here is what i suggest for moderators, IV Core, Administrators to enforce;

    1) Guideline for posting messages, use of language on this forum
    2) No personal attack in replies
    3) Contribution messages restricted to moderators, administrators only

    No body argues that IV is working for a great cause and i fully support IV and wish best of luck in its endeavors. I joined a month+ ago and may be with time i will be more convinced to fully participte in IV's agenda.

    Anyone invoking AC21 with unapproved I-140?


    It is risky to change employers after 180 days before I140 is approved. If it comes to issues, when USCIS realizes one changed employment before I140 was approved, USCIS needs to verify that the underlying I140 was approvable at the time the change of employment occurred. By approvable it means that at that time there was no reason to issue a major type RFE for pending I140. If, for instance, the USCIS notices that at the time one invoked AC-21 and I140 was not yet approved and the I140 petition did not include (or included incomplete) educational documentation, it will say that the I140 was NOT approvable due to material evidence missing. And, at that time AC-21 can't work and may cause huge issues. One should be very wary of this and in general attorneys advise to wait until I 140 is approved before invoking I140.

    I don't think consulting firms are alone to be blamed.

    Lets say there are around 1000 consulting firms it the worst case there may be around 1500 firms which have a capacity to apply 15 H1B each.

    still the number would come around 15000 to 30000 but the big 4 companies in India got 20,000 H1B last year, which means they might have applied around 45000 to 55,000 applications

    my numbers may be bit off but i think Big 4 companies from India are doing more damage then consulting firms in US.


    Guys.. i'm sick of this nonsense.. I mean this is ridiculous.. this is my second go around in this stupid lottery.. last year I hadn't graduated so they put me in the bachelors quota.. this year the freaking masters quota is full.. i have a genuine offer from one of the big 4 accounting firms.. and have work experience to back it up

    i'm sick of these consultant firms.. i wish I could work for the uscis and weed out these miserable cheapsters.. 6 years toiling in their education system, paying the damn taxes, and waiting for 1 smart person to come along and tell them its time to take care of these consultant companies and their consultants who get the jobs based on deceit and conmanship..

    simple non sense.. random selection .. my behind..

    I really feel like sending flowers to the uscis similar to what the indian folks did last year..

    Contending that the H-1B visa programme is being abused to displace qualified American workers, two US lawmakers have asked nine foreign-based firms, including some leading Indian companies that used 20,000 of such visas, to disclose details about their workforce and their use of the special programme.

    The companies the senators sent letters to were Infosys Technologies, Wipro Ltd., Tata Consultancy Services Ltd., Patni Computer Systems, I-Flex Solutions Inc., Satyam Computer Services Ltd., Larsen & Toubro Infotech Ltd., Tech Mahindra Americas Inc. and Mphasis Corp.


    It is actually good. There are abuses in H1B program, some of these companies apply for mass H1B's before the quota is complete. They apply for H1B's even if there is no current requirement. Once the H1B is approved, they will send the employee when there is a requirement and that too for some specific time. This is abuse - genuine companies who go by rules have a lengthy procedure to fill a position: open a req/interview people/if the candidate need a h1 then they will file. By this time all H1's are over. These companies are worse than desi body shops - atleast some of smaller body shops apply for green card; but this big name IT oursourcers named by senators dont apply for greencards (there might very very few exceptions).

    I saw the show yesterday. It is very sad that people like lou dobbs are twisting the facts by saying around 700,000 H1b visa holders are overstaying in USA. Also on that show one senator named "TOM" forgot his lastname, is saying the same and also that guy even did not know how long H1B is valid, he says it is valid for 5 years after that H1b visa holder become illegal. These kind of people spread hatered among common people against immigrants. is there way, we can sue these guys for their racist remarks/ misleadeing information?


    i did watch the show, i feel my blood arousing to fight back. Well, we can try exposing his false faces to other TV show hosts like msnbc, foxnews etc.
    Am sure there should be some law point to help us sue this guy.

    I want to bring out the plight of legal immigrant community that has been silently suffering the consequences of a broken immigration system. It really baffles me that all the focus in immigration debate is on ILLEGALS when highly educated LEGAL immigrants who play by the rules, pay taxes and follow the law are left in the lurch. Attending to legal immigrants plight will also send a positive signal to the ILLEGAL community to see the perks of being LEGAL. Right now, it seems more rewarding to be ILLEGAL than pursue the LEGAL route towards immigration. What an irony!
    The country based quotas imposed on Employment Based green cards are not only unfair but self defeating because the benchmark is country of origin and not qualification! Since these EB category based green cards are awarded for professional skills, imposing a country based quota just does not make any sense. I urge you to work with Congress and change this discriminatory policy and reinforce that America is truly a society that celebrates meritocracy.
    The immigrant community is really looking at President Obama to deliver on his promise of CHANGE - Change that we can believe in.
    good initiative ..I have sent the email and I will be asking my wife to call all her friends and spread the word. guys do the same.
    I also mentioned that I wanted to buy a house since a long long time but I cannot buy because of gc delays

    I sincere hope Dream act pass. Illegal kids suffer more. Our suffer less. Parents made mistake. Why they pay?

    Its your stupidity to talk like this.
    Then what about the people who want to immigrate legally and stand in the line for many years.

    If they do pass DREAM Act now, the same thing will releat again in 2016 or 2020 .

    The solution is really to deport all the illegal immigrants and to tighten the borders.

    We are the one who is paying taxes and every year and thousands of dollars insurance.

    If you do them legal (Young Illegals). simply, they will collect their Food stamps and their unemployment wages happily.


    See to improve the economy really , they need to give the green cards to young talented legal people. then people like me and you will buy a home here with out any fear. You dont send money any more to your own country.

    Its good that you are thinking of ideas but I do not think you know about the reason why we are all here on IV. Here is why.
    #1 You need o spend time on IV and learn about it rather than just coming , opening a new ID and posting a big idea.
    #2 You have not seeing Lobbying in Action. Go see yesterday's 60 minutes and how IRA controls US politics via lobbying
    #3 If charity was the way to get things done, Bill Gates would have been the first to get unlimited H1B visas every year for Microsoft.
    #4 You need to establish your credibility on the forum by contributing so that people take you seriously.
    #5 If you really want to raise $5 million and donate to America it will do nothing. How about raising 5 Million and donating in Africa and feed kids dying of hunger. It is better than investing in education of US kids who are anyways pampered and spoiled by free school education, free transport and free meals.
    #6 Maybe you should do a lottery of $5 million once collected and ask all Americans if they want to win it. You will get more media attention if that is your purpose.

    Now coming to the point of raising 5 million. Forget it man. Desis and Chinese are very frugal. Unless they are in deep immigration problem they will not even give you $5.

    Now tell me how you are going to get email addresses. That is really a big plan. I think you should get those email addresses and give it to IV. But how will you do it? There is no such list buddy.

    Yes you are right, there is bound to have EAD flood in market, with spouses of hi-tech worker will come to market to search hi-tech job with spouse phone support. I have seen such cases countless times in past few years and yes they will be in future without exception. However, matter of fact, these fresh EAD (previous H4) don't get the dream job in first attempt, it takes good 2 year to find a similar job that H1b hitech worker does.
    But thats the realty of market, every year new jobs are added and every year new job seekers join the crowd.
    On the otherside, a hitech worker is suppose to always learning something new and getting his/her position more stronger everyday, its a knowledge market, whoever knows more gets better $$. With my 7yr US exp and total 10 yrs CS exp I have no scare that any single fresh EAD will come close to me. A senior is always a senior no matter which field you talk.
