Those are good points. We are not all Indian or Chinese on this website and in my case I moved to the US because of insecurity in my country (got kidnapped twice). If I went back there I could have a top job with a top company (and have had many offers) but that is not a place where I'd like to raise a family.

I have lots of Indian friends and I think Indians are easily one of the very nicest people in the world while being smart too (not conceited), plus they speak English. (Nothing against China, but it would take me at least 3 years to learns OK Chinese)

Nag, u r in a bad situation no doubt. But u had every chance to apply for labor via PERM as well (many of my friends did that) just to be on a safer side. So u r partially to be blamed for ur sorry state.

get an attorney and explain ...ur case..
what my friend was told...if you have given proper notice to quit...your employer has no legal standpoint to harras you.
dont worry abt that desi employer..that bum is in bigger soup than you are...the law that requires all employers to provide W2 before jan 31..no matter what..check with IRS if you want....he is toast! .;-)
take it easy.. you will be all right!

From my conversations with various attorneys - this was something that USCIS could do on its own, and had intended to do for a while. It is great news for a lot of people, me personally as well!

We all know that LC can be used by the employer for substitution and I-140 is owned by the company too. The employer cannot be charged with anything even if you take him to court as he has not done anything illegal, except for breaking the verbal agreement between you and him. What you can do is take the wire transfer details or copy of the check you gave him and tell him to give your money back or you can prove in local court that the money was transffered to you (if he refuses to pay back). Of course this would mean you will probably lose your job and the H-1 status. Basically you will have to swallow this pill and just wait till dates get current or do H-1 transfer to another employer.

Sent both the faxes.
As of now, I believe 217 faxes have been sent.
Last time, I had got 7 of my friends to send the fax ( against my target of 10 ). to make up for the poor performance and to contribute a little bit to the huge efforts done by the core IV team, this time I'll get 25 on Monday when I'm in the office ( good that my manager is out of office :-)

I understand that there is lot of fear among applicants that USCIS might retrogress the dates interimly sometime in july due to the expected high volume of applications filing in the begining of july.
To minimize the chance of USCIS from taking any such steps, shall we all unite and file the applications on a specific date in july probably on 30th of july? This will accomodate all applicants...so that we shall all be winners and use this opportunity to our advantage instead of competing amongst each other...where only a few will be winners and others will be loosers.
This will also reduce the pressure among applicants , attorneys and doctors.
Can the AILA cooperate? Will there be unity amongst applicants to make this possible??? any ideas ??
When I think, you guys have reached the bottom of madness, you keep digging deeper...As such there is enough madness with INS in allowing every tom, dick and harry who filed in 2007 to be on par with those poor souls who have been waiting since 2002/2003/2004...And add to that fact that, you already got approved...And you want those poor souls who waited long enough, to wait for those lucky 2007 filers...Can your suggestion get any madder? :eek:

I don't care about LS. Almost all cases I know are fraud. Sometimes 2 guys got GCs on same labor(since they were not asking Original LC). Thank god USCIS banned LS.

We in IV do not differentiate on members on what methods or case scenarios they use or have used to obtain a Green Card. We need all our energies to be focussed to support IV initiatives. We need to refrain from any language that introduces confusion or division within the community. Even though "freedom of speech" or opinions are encouraged, we absolutely cannot say anything we want and get away with it in a common forum, can we?:)

I140 should be approved or approvable at the time of filing. Yates memo is very clear on that- I-140 approval is not required in concurrent filing. Also there is no salary requirements on invoking AC 21. Again, please read Yates Memo.
Requirements to change employer when GC is pending:
- I-140 should be approved
- More than 180 days should have passed after filing I-485. The clock for 180 days starts from 485 receipt.
- Approved EAD
Significance of 180 days barrier
If you have approved I-140 and EAD, you can change employer without having to wait for 180 days. But then your employer can revoke the I-140 which invalidates the 485 application. After 180 days from I-485 receipt, I-140 cannot be revoked so that is why it is always recommended to invoke AC-21 after 180 days from the 485 receipt.

1.) You new jobs has the same or similar job description as mentioned in the green card labor certification application

If you fulfill the requirements mentioned above, you do not have to inform USCIS when invoking AC-21. You just switch employer. At some point USCIS will send you a query asking for the information of the employer who continues your green card application. It is best to take up job where the job title and job description is exactly the same as specified in your GC labor certification application. Any variance in the job title or job description could be extremely damaging to the GC application processing.
It is best to not to change to an employer offering you anything less than the wage rate specified in the GC labor certification. On the higher side, it is better not to take up a job that offers more than 4% more salary of that specified in the GC labor certification. It is hard to resist 20-30K higher salary, but one would have to resist the temptation for taking the job offering higher salary. Otherwise, there is a risk of USCIS denying the GC application.
USCIS doesn�t account for dollar appreciation or devaluation. USCIS also doesn�t account for annual inflation when calculating the wage rate. So even if your labor certification was applied in 2003, you still have to continue at the job with the salary specified in the GC labor certification. If GC application takes another 5-7 years, then you have to continue with the salary specified in GC labor certification application.

Finally, its easy to say this, but really hard to follow - don't discuss this to your fiance(e) before wedding about the complexity of the situation, unless she is very understanding and can take it without a panic. Most of all, take it easy, relax and enjoy your wedding.

This discussion should scare many many people. I can count so many people just over the top of my head who would have a similar problem.

I came in US on 06/03/2001. When I came I was told, no project for me right now and I have to wait. I waited till 09/11/2001 WITHOUT pay.
The first time I was on my company payroll was in 09/11/2001. Since then as of today I am working continously.
AM I IN PROBLEM?
Please comment and give me hope.

I think all 3 of them (Husband & 2 wives) should apply for their own H1B's and make it here and then apply for separate GC's.
