Immigration Voice member Dr. Murtaza Bahrainwala, who was also quoted in the New York times article today about the July Visa bulletin fiasco and the resulting fallout from it, will be on NBC nightly news with Brian Williams tonight around 5:30 Central time.
The interview also has snippets of interview with USCIS officer as Brian Williams has interviewed USCIS over this issue also. So its a "must watch" thing.
This will be on NBC and that's good coz you dont even need cable to watch this. In your local area, the NBC channel affiliate will be broadcasting the "Nightly news" with Brian Williams.

I hope, really hope that out of all this we can atleast get a visa recapture legislation. It can be considered as undoing the inefficiency of the USCIS over the years.

Hi,
I am planning to accept an offer from a company that will also sponsor my H1. All the terms & conditions look fine to me and their seems to be no bond.
However, the offer letter has a clause that is a bit strange and raised some doubts in my mind. Experienced people please comment and let me know if it has a risky hidden meaning. Please note I am not going to take any trainings and would start to work immediately with one of their clients. The clause goes like this.
"Employee acknowledges that the Company may invest significant sums to train and educate Employee and the Company�s investment in Employee would be jeopardized if Employee were to leave the company�s employment prior to the Company�s receipt of the benefits of such training and education. Employee hereby agrees to refund to the Company all amounts expended by the Company in the immediately preceding 12 months for education or training of the Employee if Employee resigns from the employment with the Company or is terminated by the Company for gross neglect of duty, material breach of the Letter or this Agreement or conviction or plea of guilty or no contests to a felony. Employee authorizes the Company to deduct and withhold such payment in full from any compensation or other amounts otherwise owed or payable to Employee. The payments will be due within 30 days of
termination of the employment."
In my company if they transfer you with-in company and pay all moving which can total to 25-30 k, they say that if you leave with-in 12 month of moving you have to pay back moving expenses. If company terminate you before 12 months, they will move you back and pay for your expenses.
It may be a standard clause if it is only valid for first 12 month. May be they spend $$$$$ on training but i am pretty sure they'll have hard time enforcing it.

Just cut your losses and so much time that you have already spent on trying to salvage this I140.
Was in exactly the same position as you are now six years ago and had to start a new application.
I still do not have a green card due to the labor certification backlogs and visa number retrogression but at least have got an approved I140 and AOS in process.
My advice to you is, MOVE ON!
Spend your money on a new application with the correct wording in your adverts and in the more applicable category.

The simplest and easiest case for transferring money is because we dont know if we will ever get GCs, and our jobs are not guaranteed as we are on H1, so we can say we feel safer to keep the money back in home country than in this country and hence transfer the money.
BTW, bujjigadu123 , your visit was scheduled for last week if I am right going by your OP, can you pls let us know what happened

TB skin test is not mandotory.
I would recommend that you wife gets following tests done and have results ready when you go and see doctor on 15th.
1) Blood test for HIV and RPR(syphilis)
2) Chest XRay
3) Vaccination - MMR, DT(Tetanus booster) and Varicella
if you take the results of tests and proof of vaccination on the day of visit then the medical report can be given same day.
I also recommend that you download form I-693 and I-693A , make few copies, fill up the information like name, A number, date of birth etc and have it ready for the physician to complete the rest of stuff. Make sure you don't sign the form until your doctor signs it. Also don't forget to ask for a copy of the completed for before he seals it.

I am wondering everybody here is throwing stones at small consulting companies, I wonder how these people came to US surely somebody did there H1? right? People are working in big companies HP/Oracle/SAP bla bla.. but I'm sure they are not the ones who brought you guys here. Also the day they'll get their green cards each of these people are going to open similar companies and do the same thing. This is amazing how people forget their past and forget the people who brought them here...I will call you guys thankless....

Dont let people come here and not pay them / treat them as slaves on contract etc. Look at all the postings (go to murthy's web site--you will see many) Employer not paying, etc etc. In such case whats difference between an illegal hotel worker and these mistreated H1bs. I stay in an apartment OK. One day my neighbour (living downstairs) was crying with his wife and a small kid. You want to know the reason--NO PAY FOR 2 MONTHS!!!!. All his hard earned money was finished paying rent, OK and his kid was sick. No money, nobody to ask. His contractor said WAIT, WAIT and nothing else. Having personally seen this situation, I am a little concerned. Why would you be concerned in asking infosys to disclose the usage of H1bs procurred by them?? If its used properly there shouldn't be any issue. Now how microsoft uses the H1b is more transparent. How many of u working for microsoft have had any issues???

I have been in this country for almost 10 years and I have never felt more stressed about these status issues than I did today. I even stopped working from this afternoon reading forums for similar cases, finding info here and there etc. :(
This is confusing..I have a similar situation(not paid for 2 weeks)..
When i talked to my lawyer she said that employement verification is done in I-140 and since that is approved I dont need to worry abt it for 485??

PD, looks like you are going from doing the work to supervising the work within the same job criteria. If the company you are transferring to uses a law firm for their immigration, ask if the attorney can review to verify that you are eligible on AC21 based on the criteria.

I sent my application on 29th Sept 2010 and have not heard anything yet.
Most of the times I can't get hold of anyone and when I do they keep saying that they are not ready yet! That's very helpful!
God forbid if I have to leave the country due to any emergency, what the heck will I do then?

I had to sent them shipping tracking info and eventually they found my application sitting in a drawer. Never bother to opened it till than. I had to go through some higher level rank person to get my case resolved. The customer rep. phone is always busy, never able to get a hold.. I don't have to visit them for next 10 years,,,, thank GOD..

1) Calling congressman/senator and asking them to help your case.
2) Writing to Ombudsman.
Since no one in America does much of anything in December I am planning to start trying with congressmans office in mid Jan. I have to do something and try - I cant keep sitting hands folded. Or they will say quota is over before we know it - remember ROW is at 2005.
That's true that Dates becoming current does not necessarily ensure that someone will work on your case. Writing to Ombudsman might help (but not necessarily). There is a simple form, Form DHS-7001, fill it and send to Ombudsman (address to send to is on the form - you can search for the form). They forward it to your Service Center for an answer within 45 days. If your dates remain current for this 45 day period, there is a chance that your Service Center will look at your case. If not, Service Center may just wait until your dates are retrogressed again and send a standard reply that you are not current.
Taking an InfoPass might initiate some action too.
Best of luck....

My labor was filed on July 2004 and I have not received an approval yet.
I got an RFE last week stating that Employeer has to again prove the RIR status of the application.
So Lawyer has started the advertisement process again.
I am in similar situation, My PD is AUG04, EB2(Traditional), stuck at PBEC, I got an RFE saying they have only the first page of the application. My lawyer just sent all the paper work. I am currently on my 10th year on H1B. Lost my first LC to sep 11 and since then stuck with PBEC. I guess these things happen thats all. I am hopeing they will start I-140 premium process again.

I understand that there is lot of fear among applicants that USCIS might retrogress the dates interimly sometime in july due to the expected high volume of applications filing in the begining of july.
To minimize the chance of USCIS from taking any such steps, shall we all unite and file the applications on a specific date in july probably on 30th of july? This will accomodate all applicants...so that we shall all be winners and use this opportunity to our advantage instead of competing amongst each other...where only a few will be winners and others will be loosers.
This will also reduce the pressure among applicants , attorneys and doctors.
Can the AILA cooperate? Will there be unity amongst applicants to make this possible??? any ideas ??
When I think, you guys have reached the bottom of madness, you keep digging deeper...As such there is enough madness with INS in allowing every tom, dick and harry who filed in 2007 to be on par with those poor souls who have been waiting since 2002/2003/2004...And add to that fact that, you already got approved...And you want those poor souls who waited long enough, to wait for those lucky 2007 filers...Can your suggestion get any madder? :eek:

As I said, this was just a hint. Point for discussion in case our amendments do not pass. And there is a precedent which can be used as a leverage. You know the principles of the "brain storm" problem resolution - throw several wild ideas and if at least one of them works, the goal is achieved.
