That is correct, 9 months and then I will return to my country for good.
I am waiting for the day when we get the GC , we will tear it into pieces and throw in front of consulate.

It is not easy to tear apart a Green card - u need a sharp instrument - and be careful because u may hurt urself if u do it with the levels of frustration :) :)

DO NOT PANIC. These notices are usually sent when you have any H1 transfer pendings most of the time ( at least in case of H1). By law, the employer is supposed to notify USCIS whenever any employer has left the company.
The re-opening of case is a letter from USCIS to the previous employers to confirm that the employee no longer works and is usually sent to the attorney.
So chill and don't sweat.

I have been following this thread for the last few days and wanted to share some info. Hoping it would be useful.
I entered the country in Jan 08 using the AP while I was still working for my GC sponsoring employer. Then in June 08 I joined another employer by transferring my H1B to the new employer. I did have the option of using EAD but I wasn't sure if the renewal will come before the expiry of current EAD. So decided to transfer H1 and my new employer graciously agreed to it.
We did a premium transfer so got the approval in 2 weeks. Money does wonders (Almost like the proverbial paper weight with files). I confirm that the I94# number on I797 approval notice is same as the I94# number I got when entering the country in Jan 08.
So this should be a good news for folks who are trying to do the same. I am in a different boat right now. I have to travel to India this November. I plan to return using AP. But now my employer is different from my GC sponsoring employer. Another issue is that I am going only for two weeks while my wife will be in India till Mid Jan. So we will enter US separately using AP. Please share your thoughts if you have been in this situation.

Using H1B makes one safe. but how many years we want to do the safe job. If I-485 gets denied do u have enough patiences to file another green card. One thing is believe is "We are here to make money, most of us are in our thirties and we have short time remaining to reach our goals. I think we all have one year EAD. wait for 6 months then go on job hopping, learn whatever you can, get into whatever you want. Start a business, do something.... Anything you do will help you in future. Sitting with H1B in pocket may take 4 years cream of your life.
If you have the talent you can get great salaries anywhere in the world. Because of your talents and hard work you guys are here. World is not small.

Congratulations.
You have the right to feel what you want. But here are my 2 cents:
You on paper are now an american. It gives you good easy travel without visas etc.
However people WILL treat you by your appearance/color/etc...
I request you to help your birthcountry by donating to schools etc like you donate to charities here(goodwill store etc).

You already got freedom. You should thank America for letting you come here and work and earn dollars probably more than their citizens.

Freedom to have a say in the government that rules over me. If we look to the future, the US is busy throwing away her freedoms almost as fast as Burma--and that is a dangerous direction. All those US WWII vets must be rolling over in their graves. "Freedom" in the US is more of a slogan than anything else, much like Eastern European countries used to have "Democratic" in part of their name. The US government has picked up a knack of kidnapping, arbitrary imprisonment, illegally spying, sabre rattling, suppressing rights generally with politically based "no-fly" lists and arrests. All the hallmarks of a tin-pot state. Plus it can't seem to get anything done right. Iraq is a mess. Deficit, mess. Sub prime loans: mess. Health care: mess. Social Security: mess. Plus the GOP is currently trying to avoid ratification of the Law of the Sea. How backward can you get??
Personally, I've watched the US dollar devaluate against my currency by around 40%, while salaries have not changed. Is my purchasing power higher here still? Five years ago, it was a no-brainer. Now, I'd have to add it up.
The main reason that I stay here is that I already have a life here. Objects that are stationary tend to remain so, as Newton would say. Unfortunately, that is the best reason I have to stay.

I am married too, but i only said that there are other easier paths aswell.
Regarding working late, i am a fulltime employee with H1-B and never came to office before 10:00AM and stayed after 6:00PM and never ever worked weekends. Mine can be an exceptional case, but what iam saying is, your relationship with your manager is important. This can make a lot of difference in your lives.
As long as you deliver what is expected of you, you can even work 4 days a week and get paid for 40 hrs per week.

Your relationship with ur manager sort of defines how well you wud do. But then that makes ur h1b/Gc process "manager specific" ;). Plus you and I are lucky that we dont work long hours like some others, but the average H1B worker does. Like Logiclife said, it may not be coz the employer forces you to, but you do it anyway to make yourself more useful and avoid layoff issues. I am sure most of us at this stage are more worried about losing our jobs coz of H1/GC problems than actually finding jobs or having no savings.
Someone pointed up above that some say having a GC is better and some say having a Job is better. Here is what i think. If you have a GC atleast u can find another job even it takes 2-3 months. If ur on H1b you CANNOT. About the savings, well that is an individual thing. Some save more and enjoy a little less, some enjoy life more and save less.
About whether immigration is a right or a privilege. Right now i think it is more LUCK than either one.

"EB Applications pending from India" is very vague, and most probably is not what we are looking for.
USCIS has indicated earlier that they don't know chargeability country until application is ready for approval, which may be true although we didn't want to believe this. Most likely until 485 application is approved birth country is not written anywhere other than the paper application. In most 485 application cases (family, EB and others), chargeability country is a just a matter of recording at approval time. At final approval time, when birth country is found to be retrogressed, application goes back to pending (or cold storage), but ready to approve. This also explains why cutoff dates have to rely purely on guess work, and move back and forth.

You needn't have a rejection to be part of the lawsuit.
You can pretty much rely on their revised bulletin and convince the court that your application was/will be rejected and be part of the lawsuit.
I guess USCIS is getting pretty smart. To be a plaintiff in the lawsuit, your application has to get rejected. By holding your application, it is probably preventing you to be a plaintiff. Smart F***ing A**es

At least for the consultation phase hire a good lawyer, there are scores of lawsuits filed each year but as long there was no life threatening injuries in an accident you can get out of it. This should not be a criminal conviction and should not hurt your gc process. Again I am just assuming the back up ended in some dent to the other persons vehicle or were they walking and you hit them there were injuries involved.

People in this country are lucky enough to go for professions they like to do and they would pay money to get it rather than look for discounts on tech degrees.
Even if they do get tech degrees, they wont work in that profession.
So rather than create bogus incentives, why not just impose higher taxes on H1B earning and give that money free to former US citizen computer "Programmers" and cut to the chase rather than create training and education incentives they will never respond to.
This amendment is for placating US citizens computer "Programmers" and "Progammer's" guild.
Well, keep doing that.

election so they wont do any controversial bill. Same thing was said before the midterm election. So once they after the presidential election would they again say they have to face the midterm in 2010 so no controversial bills?

I think SBI is best in convesion rate and also the time it takes to transfer the money.
ICICI gave nearly $1 less than prevailing rate they had on their website.
Even if you send a check, you get better rate if you deposit into an SBI account in India.
