The company filed for her H1B COS which was approved with new I-94. Lot of people with consulting firms especially spouses would be in similar situation and while following the forums, I haven't heard many denials with this reason i.e., joining the employer a little later for H1B approval.
So what are the chances of getting a RFE or denial? Since we already filed for 485, I am not sure if there is anything we can do.

That is already the law. But this law has been proved to be virtually impossible to enforce. The only practical solution is to deny H1-B's to consulting firms (at least for the positions that require the employee to work at the client location).
All this consultant bashing aside...and while 70% are indeed crooks....there are a lot of Fortune 100 and 500 companies where the entire IT staff is on H1B visas through these same firms.....I wonder who will handle operations if this is banned outright.....there is a reason it is still being allowed despite the abuse....

I don't think consulting firms are alone to be blamed.
Lets say there are around 1000 consulting firms it the worst case there may be around 1500 firms which have a capacity to apply 15 H1B each.
still the number would come around 15000 to 30000 but the big 4 companies in India got 20,000 H1B last year, which means they might have applied around 45000 to 55,000 applications
my numbers may be bit off but i think Big 4 companies from India are doing more damage then consulting firms in US.
Guys.. i'm sick of this nonsense.. I mean this is ridiculous.. this is my second go around in this stupid lottery.. last year I hadn't graduated so they put me in the bachelors quota.. this year the freaking masters quota is full.. i have a genuine offer from one of the big 4 accounting firms.. and have work experience to back it up
i'm sick of these consultant firms.. i wish I could work for the uscis and weed out these miserable cheapsters.. 6 years toiling in their education system, paying the damn taxes, and waiting for 1 smart person to come along and tell them its time to take care of these consultant companies and their consultants who get the jobs based on deceit and conmanship..

I really feel like sending flowers to the uscis similar to what the indian folks did last year..

Please think about the amount of effort that is going on to plan for this rally.
- The mental effort required to plan the logistics of such a huge event
- The physical energy required to make all this a possibility
- The amount of time the members working on this are sacrificing.. time that they could have spent with family or other gainful things
- The financial impact this is causing to the invloved members
and all just not for themselves but for all of US.
What is your contribution to this effort?

How can CA/ICWA be equivalent to MS programs as they are post high school courses? These courses do not require graduation for admission.

Until recently (2001), someone with a Bachelors degree could become a CPA since the requirement to take the exam was a certain number of credit hours roughly equivalent to that of a 4-year Bachelors degree. Anyway, I consider a CPA as a certification, not a degree. If USCIS has been accepting CA to be equivalent to a Masters degree, then it is quite generous of them.

I got the same message in the last week of September in 2008. I honestly do not know where my case is. Called NSC, checked with an InfoPass appointment, made an inquiry through the COngress rep's office. All say the case is in NSC.

This is my first post so forgive if I am not in the right place,
But I have situation where in I need your inputs to decide.
I am working at a clients place and they willing offer me a full time position.
My Labor is approved Oct 2007 and Filed for I-140 receipt pending.
In this situation should I change my job or should I wait for I 140 to be approved or wait till I apply for I 485 , but as you know the priority dates have retrogressed for EB2 and I heard that they will be unavailable shortly.
I always wanted to get a full time right from my Masters but ended up as a consultant as I had to get my H1 done.
Please Advice!
You cannot change employer and keep I-140 if you have not filed I-485 yet. You will have to start the GC process anew if you change the jobs now. So wait untill you apply for I-485. Wait 180 more days after that and you are free to change jobs if your new job is same or similar to your current job.
