USCIS service centers are holding adjustment applications filed based on the initial July Visa Bulletin. Some applications received on the first business day were returned, but all applications since then are being held and not returned. One can speculate on the reason, of course. Possibly USCIS is preparing for a loss in litigation. Possibly they are preparing to cave sooner. Let the speculation begin....

I too had soft LUD's on Mar 26 and 27 and thereafter continuosly from 30 mar 2009 to 3rd Apr 2009 (total 7 days), this happenned after my reply to 485 RFE.
I didnt apply for EAD/AP or no other applications are pending except 485 . Recieved date is Aug 2, 2007 and My PD is NOV2004/EB3
Nembrask service center current processing date for 485 is 15 Aug 2007 , Looks like they are going through all the files in the order they recieved and pereadjucating each case else deniel letter.

Could we keep calling, even after raising one SR?
Raised an SR on 08/25/2009. Took infopass on 09/02/2009 and came to know that mine, spose and the kid got pre-approved.
Recd a response for my SR on 09/04/2009 from uscis saying that my case is being actively processed. Called uscis again on 09/04/2009 and got good scoldings from the 2nd level CSR saying in a rude and harsh tone, that I have already raised an SR and am supposed to wait atleast for 60 days before calling again.
Could I still persevere and call uscis? I was never so anxiuos or dissappointed before at not getting email.
Actually, I thought what the heck and tried it from my personal email. And they responded in 2 days. The response was all BS...full of grammatical and factual errors with strange sentence constructions...seemed to have been texted by a highschooler.
What actually worked was POJ method of reaching NSC IO.
9/3/09: IO was curt, but I insisted on assigning my case to an IO.
9/4/09: IO was all sweet and honey...told me that my case had already been assigned to an IO because of my call the previous day. (This is important, folks - getting your case assigned to an IO). She was so approachable, I asked her if she could approve my case now. She obviously said no, but said she would see what she could do. This was the best response from NSC so far. Asked me to wait for one more day. It was long weekend, so had to wait 3 looooong days.
9/8/09: IO gave the approval news. 5 minutes later, my wife called and got a really annoying IO, who instead of looking up her case, went on a tirade. That night got the email.
9/14/09: Got the card.
I did try 2 Senator's office, a really hopeless CongressWoman, both Obamas, both Bidens, Napolitano, Mayorkas, Pelosi, Ombudsman, two NCSC SRs, AILA (through my attorney). And nothing worked. It was funny that the Senator's office called me to wait 60 more days. When I told her of my approval, she was short with me. So, in my case, nothing worked except the POJ method and personal perseverance. Keep on calling until you find a good IO to help you. Good luck!

The company I work in is a medium sized business organization. My boss is a staunch republican. I hope to make him aware of these 2 bills and request him to write to the locol congressman and the senator. If we can all do the same then we can buil substantial momentum towards getting these 2 bills passed. Since most of the businesses have republican leanings and at some time have contributed towards the GOP in some way, their endorsements can have a major impact.
I have written to my local HOuse rep; no response from him.
I agree with Alabaman. We need to coordinate and do something. Waiting and watching will get us nowhere.

For eg.. I was talking to my friend in India and told him about the issues here, he did not understand, he thought I am having a tough time here and told me he has some friends in US who can help me out with immigration problems. When I explained our issues to some people here, some understood and some did not, they told me they know some lawyers who are very good and can help. One of my old employer started a new company in Atlanta and contacted me and asked me to join, but I told him I cannot because I am stuck with my ppresent employer and will lose priority date blah... he did not understand that and was confused.
I had the SAME exact problem, both, with people here (indian citizens who are now american citizens) and people back home. To the point where, once i was addressing a group of my community members and a couple of Indian american people absolutely REFUSED to belive that the Govt wud give illegals a better break than they wud give us, and that it had happened in the past. It took me half an hour and quite a few examples to illustrate how that was true.

I am not sure under what BILL they have a provision to remove US degree holders from actual Visa Numbers...but, we should also keep fighting for that because this would have two fold benefits:
1. All US degree holders will be benefited.
2. These US degree holder Numbers can be used by Non-US degree holders.
As everyone knows, most of the students will be unmarried when they enter the country for there degrees...and apply for GC after getting married....so, definitely if these numbers get eliminated from the actual visa numbers we would have double the numbers available for non-us degree holders...what do you guys think..????????

I-485 is mostly about the eligibility of the individual (like medical, illegal presence, fraud etc.) and so getting rejected at I-485 stage is not that common (especially after the approval of the underlying immigration petition). And if it does get rejected, more often than not, the individual may never be eligible for permanent residence due to the same reason. So usefulness of H1-B as back-up is of very limited narure.

I don't understand why so many are not coming forward for contributions. It is just 25 dollars. This is way less than what you have to pay for EAD/AP renewal or nothing compare to if the applicant and spouse are able to apply i485 during the retrogression, then the spouses will get EAD faster and they can earn lot more than 25 dollars within an hour. In all respects this will be the best solution if we can accomplish this. It will be easy only when we are all united and behind such a wonderful group of IV members.
I also request everyone to post a message after you contribute. This will keep this posting on top and motivate more people to do the same.

In any system if you club large group of applicants based on a dichotomy, and say you will get lesser share than the rest, isn't that how you describe preferential treatment ? Is there any other way to describe the current country-quota system?

In fact it probably makes much more economical sense to have quotas based on the subject's political or scientific inclination rather than national origin! In today's connected world, nationality has no meaning.
