For AP renewal, do I need to send photos by mail again? I thought USCIS uses the picture on file. Folks please correct me if I am wrong. Could some one PM me the letter format?

Guys, Thank you all for the support. I have responded with the same kindness.
And for those who gave reds, I always thought in spite of the gloominess, we still want to ponder at what the new bulletin has is in store. Anyways, thanks to you all too. Have now learnt that discussing future VBs has become a Taboo.
There's always two sides of a coin. Don't think much about people who gave you red but there were also people who gave you green. And in this forum red and green means nothing.
It's just that some frustrated souls gives you RED and some relaxed souls give you GREEN.
There were some frustrated souls out there who gives you RED for everything, who doesn't add any value to this forum.
And I bet even I would get for this comment.

If you really looking for long term solution then you should focus on action items that core members asking us to do...Have you done any of these?
members will file 485 whenever they can and whenever they want to. I don't think even single person should buy this idea.

could members explain this further with more information and facts if possible. we have not been covering this in our media interviews and facts about hardships we face.

Hi Guys,
After a long journey of more than Sixteen years in this country, I finally received my GC.
In short, I came in 1993 on J-1 for my training which took six years, followed by one year on O-1 visa and then J-1 waiver for three and half years in underserved area. Then applied for labor certification in Oct, 2003 EB2, through university, which was approved and then retrogressed. Applied Schedule IIA, approved but also got retrogressed. Got AILA liaison and Senetor involved.
Applied for EB1 and NIW in July 2008.
My lawyer was very much involved in the whole process, was very helpful at every step, and wrote letters to USCIS.
Finally, GC came in April, 2009 and received the cards one week later. My PD Oct 2003.
During these time, I actually had no problmes at my job or my my wife's job. Brought a house four years ago.
The main problems were:
Daughter and son could not apply to state colleges/ medical colleges. (daughter going to med school next month)
Got stuck in India for renew of H-1 for 2 months!!! (worst time of my life, with my wife and kids in US) I tied every thing from writing letters to calling Ambasador. Not effective.
Could not go to certain occasions, like death of very close family members, weddings etc.
However, I kept my cool and prayed and got lot of support from Immigration voice.
As a small token of appreciation, I am donating $500 .(and will keep on supporting)
We all are going to get GC, some sooner some later. Just keep on doing you job.

Well USCIS withdrew the Q&A they posted on their website for revision.
I hope they don't plan to screw the remaining name-check sufferers again.
They have been approving some of them in the past few days (and neither according to PD or RD, basically no FIFO, just based on officers whims)

Approving 25000 485s that were already processed and sitting in cold storage will take less than a minute.
Approving meant simply running a program that assigned a visa number to a processed case in a loop that ran 25000 times. Such a program will complete in seconds. The paperwork for these 25k approved applications is going to take months and online updates of 485 approval are still trickling in.
So there was no new found efficiency in USCIS as many seem to believe.

My labor was filed on July 2004 and I have not received an approval yet.
I got an RFE last week stating that Employeer has to again prove the RIR status of the application.
So Lawyer has started the advertisement process again.
Every step in the GC process is traumatic. One step gives less trauma than the other. But there is no way anyone has got a GC without agony (unless you had an easy way out).

United States Citizens need an Immigrant Visas Waiver available to their Alien Immediate Relatives deported with a drug-related offence of more than 30 grams of Marijuana in order to even the scales on both U.S. citizen and Alien immigration privileges concerning Deported Aliens with a Drug-Related Offence of More than 30 Grams of Marijuana.
The way things are now U.S. citizens without a criminal conviction and with Alien Immediate Relatives are being discriminated against by their own government. The needs of deported Aliens with criminal convictions are being placed before their own.
It�s pure hypocrisy and it�s my family�s and my name being placed on the line.
I mean, really, how great can the U.S. be if it�s willing to lose their citizens to aliens like me when they decide to move outside of the United States to join their Immediate and shunned Alien Relatives? If you had the opportunity of getting a Substitute labor and potentially get your GC sooner rather than later, wouldn't you grab it with both hands. It is the GC Freedom.
I am also thankful that DOL and USCIS have banned Labor Substitutions but please give those who have used them a break. They are also in the same boat as you and me (people with regular labor). Chasing the American Dream. No offense intended.:o

I am still waiting for FP notice, i got my EAD/AP/RD, for both of us.
It was filed @ NSC on July 6th, ---> CSC -----> NSC. I got my LUd on 09/21 last on our 485.

What he/she is doing is legal. Unless this offer involved payment for labor substituion, in which case its illegal. But good luck trying to prove it. Ever heard of wage kickbacks?

At some point I had a question about this issue (I-131 page 4), about which "application" is deemed abandoned and I got an answer in these forums (someone said that he/she researched enough) and that it is the I-485 application which is deemed abandoned if you leave before AP gets approved.
However, when I enquired with a lawyer, and he mentioned that it is NOT I-485, but the "Advance Parole" application (I-131) which is deemed abandoned, if you leave the country before it is approved.
1. If you have a valid AP and are renewing it, can you still travel and come back on the previous AP (provided the return date is within the previous AP's expiry date)
2. If someone has never used their AP, and has a valid H1-B stamp, would this rule apply. ie, can the person come back on H1-B even though his AP application is pending?

here is a tip for next time, never threaten and intimidate other people and think that just because they r immigrants they r weak. law protects us all equally, and anytime u threaten, when i am around, just make sure it will have a negative affect....

my non-lawyerly suggestion: do not file ac21 until well into whichever job you takel
I have read on various forums that there is no necessity to notify unless there is an RFE, but to maintain appropriate evidence at all times. you may want to consider doing that until you are well settled in whichever job you take.
by the way, what is your PD?

be filed). Just before I moved, I got another offer from company D
(which I believe best fits my long term career interests). I would've
avoided the hop to company C had I not given the notice to leave at
Company B. Now, I am looking to move to company D at the earliest (perhaps in a month). I have
been at company C for 4 weeks now.
Question:
Should company C file an AC21? Since there is already an AC21 on file (by
company B) and if I will move to company D, can I reduce one additional AC21
filing? This is just so that there aren't 3 Ac21s filed and to avoid
making me look frivolous. Please advice. If its safer to file it, I
can request an AC21 filing soon from company C.

Factors you forgot to consider:
1. EB1 and EB2 applicants this July and Aug. ate up the numbers that were made available to EB3 last June 2007.
2. EB3 Visa number is just very few, around 800 per month per PICM country.
