I second that. Who knows to accomodate these cases judge might ask congressional approval for recapturing the lost visa numbers.
I think it's better to file now, if your PD is recent.
Now that USCIS / DOS know that they have made mistake and also aware that this is exposed to the entire country. So this is what they are doing.
1. Keep all the applications pending so that AILF could not start the lawsuit. ALIF needs rejection proof.
2. Updated their site stating the receipt notice will be sent after Aug 1st, So everyone keeps quiet till this date.
3. I beleive, the Judge will rule out by July 29 saying that itis fault of DOS / USCIS and say they have to accept all the applications which are filed in July leaving the applicants only two days to file.
4. No one can argue that all the ELIGIBLE applicants should be allowed to file. The reason is NOT all the eligible applicants filed in June. Also if you feel that you are eligible for July, then you should have prepared all your application papers ready by July 29. If you cannot file, you are out.
I feel, this is what is going to happen. So better prepare your papers and keep it ready.

it's a "skin" if you were to wrap the thing celophane with your design you wouldn't see the wheel or the screen... I say play with the screen, the button but not the wheel. besides, you would rub it off in one day and then it would reaaly look like arse.

One of the IV members has requested me to post this info.
He contacted his senator to get the total number of pending EB apps for India.
Please see the response from the senator in the following link. It has pending applications by category.

good thread. I do little bit of trading myself from a personal brokerage account and made some pocket change (few hundreds by trading commodity ETFs) recently. in layman terms, can u explain wht do u mean by ' US natural gas market is in contango' .
First of all note that the original post was alomst year and a half old so dont go by the ideas there now :D
In commodity markets you trade futures and spot. Spot means immidate delivery of the under lying commodity. In futures you pay today for delivery at a future date. So typically the price of the future will be the price of spot + the storage charge (simple calculation to give you an idea considering no premiums). As the day of delivery approaches the price will pull to spot price. For example if west texas intermediate (WTI) crude is $92 spot price the 3 month future will be $100. (92+8 for storage). Considering that the spot price does not change at all, in three months time the price of the oil you will now be purchasing will be $92, but you paid $100 for it. This is backwardation. This is usually how markets are most of the time.
Now if in 3 months the price of WTI is trading at $110, you will own oil you paid $100 for and now can turn around and sell for $110. This is contango.
When you buy a commodity ETF, they dont take actual delivery of the product, they roll their contarcts. So they will hold a 3 month contarct and when the third month approaches they sell the contarct and get another 3 month contaract. If market is in backwardation then they will always be buying high and selling low. If market is in contango they will make money but as soon as it switches back to backwardation they will ride down the slide and loose all the money they made. So I dont think ETF's are agood way of making money in commodities passively. You can actively manage the ETF portfolio and make money using options and hedges and leveraged ETF's. But buy and hold, I suggest go and invest with a CTA who will be trading rule based to negate the effects of contango and backwardation.

In all areas, it is still honors based system - it is expected companies follow rules and laws. In each area, income-tax, police - law & order, business taxes, the way is less governance and more self regulation.
Most companies follow it in letter and sprit; some don't. It is natural and it is discounted. You are working for success not perfection in government. And this is a free country. If you can (one day), make a better small and medium consulting company. That's what it makes the country great.
Esp the Mom Pop Desi consultancy shops whose main objective is to prey on H1Bs...They should be banned.
I agree that its the lopoholes or worse - Loose enforncement that encourages these consultancy firms to keep exploiting the system.

There is radio talk guy Sean Hannity (Convervative Republican). He is very popular for his straight and truth talk on radio. He comes in 7:60 AM on radio from 3PM to 5 PM EST.
We could send an e-mail or call and request him if he could take time to talk about our problem. He is very much against Illegal Immigration. He always supported legal immigration. He himself is an immigrant. Most of the people in Congress know him. Probably this might be a good idea and hope he will talk about our problems and this wrong propaganda about us not paying taxes.

I am not sure if its legal or not but various members can contribute their skills in exchange of donation to IV. This way members with skills are giving their time to IV and Members of the forum are getting sound advice/guidance/service for small contribution to IV. I heard that it needs to be at least 21 months to be able to win the law sue...and suing them might not work anymore when my pending time is qualified.
If someone else with similar names/same birthdays commited a crime, why do we need to suffer as a possibly "HIT"?
If I were to wait for 4 years for Name Check, I rather be the person commiting the crime so they can reject my I485 instantly.

I doubt if any one can clarify this question more than what is already said so far. Neither DHS nor USCIS specified the minimum time one should stay with the (GC-sponsoring) employer after becoming PR. At the end it comes down to establishing your intention, that is, making sure your decision does not raise a red flag when USCIS pulls up your employment history later (during your citizenship interview, or if something else triggers a background check, e.g. your employer being investigated for a potential fraud). There are mitigating circumstances that should help if you leave early, such as being laid off soon after becoming PR, or as someone pointed out, if you invoked AC21 while waiting for GC etc. (These are things I admit I do not know much about, as my own GC was self-sponsored.) We are talking intangibles here, and you are unlikely to find any set-in-stone rule.
Having said that, your decision should not (read never) be dictated entirely by how USCIS may interpret your intention. There are other priorities, such as family, that should come first and foremost. After years of letting USCIS be the lord-and-master while we waited for GC, it is high time we step up and take control of our life. Besides, after looking up several threads over quite some time, I did not come across a single case of anyone being denied citizenship, or having GC revoked, on employment history alone. (The biggest deciding factor has almost always been "moral character".) Knowing the importance of this issue, if any of you have read (not heard from a friend of a friend of a friend of a...) a counter example where someone indeed faced problem because of employment, please post the link.

My wife attended interview on dec 6th..we are calling consulate everyday to find out the status but only got scolding from them for our calls. I have decided to travel alone because of this. please plan leaving some gap. block tickets with your airlines instead of confirmed reservation.
