All the data shows that we have 20K EB2 I/C with PD before 6/1/2006, and it is comparable with the unused 20K quota from EB1 and EB2-ROW. As stated by Openhemer, the 2 year jump is due to the spillover of 20K to EB2 instead of EB3-ROW and there will NOT be any significant retrogression in Oct. However, a petition is being organized in this forum to stopping this spillover. Only if the petition succeed, we will see EB2 date goes back to 2004.
EB2-India folks should also initiate a petition campaign (on lines of the EB3-India folks) to make sure that these 25K visas do get adjudicated before fiscal year �08 ends.
USCIS may well end up wasting a bulk of these visas, contending that since they are statutorily required to adjudicate all EAD applications within 90 days, and there is a surge in EAD renewals because of (a) July-07 visa bulletin fiasco; and (b) people applying for renewal this month, hoping to get 2 year EAD. I think IV core must be taking some action in response to this CNN report. Does anyone know about action from core?
You are also part of IV. You can stand up for any such mis-information and educate rather than waiting for Core team to do something (they may have other priorities)

Sorry if this is offtopic but can someone explain to me who banned me and why? I didn't write anything offensive or abusive, and I didn't insult anybody. I was just discussing the issues I read in another forum.

May be we should do some thing dramatic. Like sending letter to Canadian Government, here we are 1000 skilled people with extensive experience and International degrees. Collectively we going to bring in $1 million or more. Can you expedite our Permanent residency!!

That's probably the path most people with (EB3 2003 onwards/EB2 2004 onwards) will take from now on. The only hurdle is there is no clarity about the law regarding H1B extensions granted on an approved I-140. Most people have run out of H1B and will have to change jobs on the extensions. I hope USCIS issues a clear guidance on this issue. Also you might not have to let go of the priority date if your company is kind enough.

we will have to ask for more pointed info rather than ask for all the info at once.
My suggestion is for a few of us to ask USCIS for just EB - 2 India, China and ROW and another for just EB-3 India, China and ROW. Maybe we might get a faster response that way.

If you don't know how the H1B Visa works first educate your self and then give the facts to the senators. I am not sure where you get this info.
(1) The six-year visas allow foreign workers to bring in their families, and guarantee thousands of anchor babies.
So u say that people on H1 should not have wife and children????
(2) H-1B salaries are tax-exempt - no FICA, no federal or state income taxes. They can live at the same level as tax-paying Americans at a lower cost. Therefore, Congress allows foreigners to "low-ball" American workers.
You people eat on the taxes that we pay and leave once our 6 years are compelte. Can you show where and how the H1B's are tax exempt.
(3) H-1Bs can leave the job they came to fill and seek other jobs, not necessarily in the "hard to fill" category.
H1B's cannot take any job as they like first they have to get the H1 processed by that company that is willing to employ them. If you don't know how H1B works then educate your self by going thru the requirements for the H1B.
(4) Most H-1Bs are of a "protected" ethnic group, so H-1Bs have an affirmative action preference when competing with Americans for the same jobs.

Following advice of 'Googler' i skimmed through the USCIS OMbud's report. So USCIS is not able to accurately 'count' the cases because old cases at local offices are not accounted in system (?) . Otherwise it would have been a quick data base query to obtain whatever statistics.
And i was interested in knowing how many India EB2 pending till Oct.2002 ;-)

are color copies necessary. I'm clueless and trust lawyer's office to know..they seem they know what they are doing. I wasn't asked to make copies, just bring in my recent passport (i have 3 old ones...been in this country too long on F-1 etc) and I'm assuming she made color copies..not sure. Is that trouble?
Also do you NEED to submitt ALL your previous stay details on F1 etc and have all docs related to that. They didn't ask me all that, only H1 stuff as I've been in USA for 16 yrs, so it's hard to give everything related to that...
Please advise. I know I will get RFE anyways as I don't have time to get the medical done and will be submitting without that and most likely with a copy of PERM, not actual hard copy, since it won't come on time.
Plz advise....thanks...oh and the fees are? Nervous. lawyer made me make checks payable to USCIS and I see some people sayng "dept of homeland security"...please advise.

Well ... that's the sad part. Everyone in core team is probably reading this but no significant feedback or suggestion has come from them. May be they are all too busy or this topic doesn't have any merit or has been discussed in depth already before. I am not sure what's going on.
