AILA and all the immigration lawyers and many employers threw a hissy fit when DOL wanted to shut down labor substitution.
They lobbied hard at DOL to allow the continuation of labor substitution. IV has tried to get DOL to eliminate labor substitution or at least make it such that the Priority date is not the labor filing date but the 140 filing date. Allow labor sub with PD = 140 filing date will solve the problem of cutting in line and getting ahead in an unfair manner. It is dark age for immigrants in America. They are just inventing ways to harass people. There shouldn't be a reason to issue EAD or AP in time. They have increased the fees several folds in recent years. They want us to run pillar to post for everything, be it work permit, travel document, driver's license...Just discouraging aliens to live in this country.

Hi ,
I sent i140 papers and money in feb 2007 to my company. in april i went to india and came back in May. in May when i asked the recieved number of i 140 filing to my company then they told me to wait for 2 week and after 2 week when they gave me recpt number, i checked online i saw following message.
"
Current Status: Case received and pending.
On May 16, 2007, we received this I140 IMMIGRANT PETITION FOR ALIEN WORKER, and mailed you a notice describing how we will process your case. ..................
"
looks like my company sent paper to USCIS in may not in march or april. is that currect? is the USCIS receipt date is the i140 filing date and gc cut off date if CIR bill passes? please throw some light on this.

Define "unprofessional" and how it applies to the replies here?
In what part of the world is standing up against drug peddlers and traffickers is limited to "personal" interpretations of moral? Drug laws are not intended to satisfy some lawmakers personal morals, but it is there because selling drugs is illegal regardless of what yours, mine or anyone else's personal moral fabric is.
We are not talking here about the idea of sex before marriage, , drinking, or other values that are left to the individual's personal moral beliefs. We are not talking about that here. We are discussion DRUGS in case you were not paying attention.

only reason USCIS can afford to do it is becoz they are not accountable (As we are not a vote bank)...

Let a group of 10-25 people tie themselves on chainballs and handcuffs (or fetters) and march 1 mile to the USCIS office. Get this event covered by media..
Hold banners like "Free us", "We want EAD", "i485 NOW" and raise a few slogans
In addition someone can dress as Uncle Sam and pretend to whip the prisoners..
I have 2 questions. Why you think only I485 not greencard. Fight and get Greencard? Start protest self. Others join when one start. Why not you?

sadly because of the way the GC process works, even that 'eight years ago' part makes sense: he got hired by that company 8 years ago and probably started his LC. After the company got acquired, the acquirer restarted the GC for everyone (typically a successor in interest company picks up the GC as-is and things can continue, but there have been cases where lawyers recommend restarting because of all the changes in the job location/profile etc).
Many people who came here in 2000/2001 have a PD of 2005/2006. It really sucks (I am in the same boat)

This is abuse - genuine companies who go by rules have a lengthy procedure to fill a position: open a req/interview people/if the candidate need a h1 then they will file. By this time all H1's are over. In the same lines as H1B, could we look into if its possible to add a quota for US Masters degree holders irrespective of country of birth for green Card also. This would be in addition to the existing Employment based quotas.
Does anyone know how they added 20k H1B quota for Masters degree holders? Who sponsored that bill? May be we should talk to the same people.
I would think there would be a little less resistance for this? This would ease the pressure on both EB2 and EB3.

Why is everyone blaming just the Chinese University for trying to circumvent the immigration system? It says 95% of the students were from Andhra Pradesh. These are the people who are causing delays in reforms and we pay the price by being stuck in the hole. The founders and all these students should be deported and banned from entering the US for life.

To my knowledge, bench non-pay violates H1B rules. If you are on H1B you are required to draw a salary every month.
I do not know if bench non-pay violates AOS pending status.

I am worried that my new offer letter with Java skills mentioned would create a problem for me.
