    All this while we legal folks have been renewing our H1B's with overlapping time intervals so taht there is no Gaps....now that sounds like a stupid thing to have done....

    ....I am not sure why someone is portraying Infy or Wipro as companies that go for "Easy money..." that's completely ridiculous. Agreed they are not doing lots of so called high-end R & D projects and majority of thier revenue is still from service industry. But that does not make these companies any lesser.

    I am not sure how much insight you guys got into these companies, but they are doing quite a lot of good assignments. Also, the processes they got in place & the maturity they show in execution of assignments is definitely on par with any other software services company in the world.

    Probably a bunch of you folks are frustrated with these companies because the billing rates are driven down & opportunites in US (for consultants) are becoming less due to these companies' offshore model - but that does not make these companies shallow as you are trying to portray.

    PS: I am not an employee with either of these companies. FOr that matter, none of these offshore-based companies. But the facts are to be accepted.

    I would rather stay out of this discussion... but I am in complete agreement with your point on "processes"!
    So far in my experience in IT consulting in the US, I have almost never seen the same level of detail in following software development processes as I used to see when working offshore for organizations doing the same kind of business as these two companies.

    I had gone to India for my father's 75th. b'day and planned to get my H-1 renewed. However, when I went to embassy, they said that I have to get clearance and will take one week. I said fine. One week became two weeks, then one month and then two months. I tried to contact embassy and other people, but of no use. My chief here in US, also tried. Meanwhile, my AP had arrive in US (we had filed for I485).( My wife had already got her H-1 approved and she had gone back.) She send me the AP. I contacted two of my lawyers; one said it is fine to come with AP, other said no. I send a letter to embassy asking about my travel with AP. They said, it is legal and not suggested!!!.
    So after waiting for two month, I took a chance and came here on AP. At the airport, they took more than one and half hours to get be cleared, meanwhile my wife was waiting for me outside, not knowing what was happening. She was in tears when I came out finally.
    After I came to US, I was informed from India that the US embassy had called and said that my name has been cleared and I should come to get my H1 visa stamped.!!!!!!!!

    +1 for CGNY. We had gone for our daughters PIO card and had her with us - the consulate folks were extremely helpful and helped us through the process quickly so that our daughter wouldn't go through any discomfort in spite of a huge rush. We were in and out in less than 30 minutes of reaching the consulate (kudos to the security screener especially who spotted us waiting in line and led us right in to the counter).

    Everyone was also very friendly and professional. I do agree with the phone calls responsiveness - we had a hard time reaching someone on the phone for our queries.

    and how are you so sure that all EADs that will be entering the market are freshers. My wife (now on H4) already has 4 years exp in UK (psychology) before coming to US. I know a lot of H4s who have 7+ yrs exp (may not be very recent as they couldn't work on H4). So most of them may not be freshers but yes, competition is always healthy.

    Yes you are right, there is bound to have EAD flood in market, with spouses of hi-tech worker will come to market to search hi-tech job with spouse phone support. I have seen such cases countless times in past few years and yes they will be in future without exception. However, matter of fact, these fresh EAD (previous H4) don't get the dream job in first attempt, it takes good 2 year to find a similar job that H1b hitech worker does.
    But thats the realty of market, every year new jobs are added and every year new job seekers join the crowd.
    On the otherside, a hitech worker is suppose to always learning something new and getting his/her position more stronger everyday, its a knowledge market, whoever knows more gets better $$. With my 7yr US exp and total 10 yrs CS exp I have no scare that any single fresh EAD will come close to me. A senior is always a senior no matter which field you talk.

    I know after we file the i-485 for 180 days, we can change our jobs. But rule is that the new job should be in the same field as the old one.

    Can i change my job from a biological researcher to a biostatistician? My current job is in the field of biology, which involves lots of experiments. If I change my job to a biostatistician, which is like a programmer, do i still qualify the "similar filed" rule? thanks for your help!

    You can change you job after 180 days with an approved i-140. And job description and duties should be same or similar. So would you say the job duties are same/similar?

    Probably you are right. But the issue is not the country limit!!!!!!!!

    Take example EB3, how you think will look like EB3 on the next visa bulletin without country limits. EB-3 probably will be June 2002.:eek:

    Guys we see a very unhealthy trend here where any disagreement is not tolerated. This forum is for legal skilled immigrants and we sometimes show how unskilled we are when it comes to tolerance of opinion here.

    isantem, while I understand the diversity argument, when it comes to skilled immigration it doesn't really help. The data itself shows that the overwhelming number of skilled immigrants come from India/China. If the objective is to let the most skilled immigrants in, then the US should forget about diversity. Unfortunately in terms of volume and talent combined, India and China handily beat the rest of the world. Even if EB3 goes to 2002 so be it, but at least you are treating all skilled immigrants on a level playing field rather than discriminating them based on where they were born. If the US continues to do this, there is a serious danger (and this has been documented) that skilled folks in India/China will no longer find the US attractive. Its already happening with the economy booming in India. In fact, we'll probably see you or your kids standing in line for an Indian or Chinese green card in a few years (and I doubt India or China will focus on diversity when it comes to attracting the most skilled talent).

    Everest Technology? Sounds so familiar, but definitely they are not in the list of blood suckers I dealt with.
    There are thousands of bloodsuckers like this one, they know the Immigration law better than anybody else do, they will do anything to stop you from leaving their company.

    BTW, you don�t need the copy of I-140 for using AC21 portability.
    You might need a copy when you apply for a 3 years H1 extension, double check this with an attorney.

    If I were you, I wouldn�t stick with this employer, I would definitely use AC21 after 180 days.

    I worked for Everest Inc for the first six months in the US and I came through them. They were ok with me. Even though I left the company before 1 Year, they did not charge.

    I am not sure whether we need to have a original 140. I never asked my employer and even they did not mention about that.

    When they ask 245i (April 2001 Deadline) people to submit the application for legal status (Labor.. i-140 ..etc) why didn't they also create the VISA Number for them?
    It's legal immigrant taking the hit because of illegal immigrants.
    They should define completly different path and laws to make illegals to legal.
