Here is something from my lawyer
quote
USCIS is no longer issuing rejection notices. The are now "holding" the applications. This means that if your priority date were to become current sometime soon, but your case was at USCIS, and they were not issuing receipt notices because your case was being held in the mail room, you would have no choice but to recreate your case, pay new fees, new medicals, photos, and file again.
There is also an outside chance that USCIS could keep your filing fees, which would make you subject to paying them again with a new filing.
unquote
This was part of the document we have to sign and send to the lawyer expressing our understanding that costs are involved.
I think by holding applications USCIS is trying to reduce the number of people from filing in july. This armtwisting tactic will reduce unnecessary overload in their mailroom and reduce the number of people in the july filing class as far as any lawsuit is concerned. Maybe just another move to reduce losses or any complications if any lawsuit is successful at some time. The smaller the number of beneficiaries the smaller the headache.

There are more than just national anecdotes, however. Everyday Americans are affected. Since looking into the H-1B visa program, some of my constituents have come to me and spoken out against abuses they see.
Another constituent sent me a letter saying that he saw firsthand how foreign workers were brought in while Iowans with similar qualifications were let go. He tells me he is a computer professional with over 20 years experience. He was laid off and has yet to find a job. He states: I believe [my employer] has a history of hiring H-1B computer personnel at the expense of qualified American citizens.
I received a letter from a man in Arizona who works for a company that employs dozens of H-1B workers. When he asked his supervisor why so many foreign nationals were being hired, the head of human resources said: If the company has an American and a person from India, both with the same skill set, the company will hire the person from India because they can pay them less. These are firsthand stories from U.S. workers.
I ask those begging for an increase in foreign workers to explain these cases to me. Why are Americans struggling to get jobs as software developers, data processors, and program analysts?

You could lose your job to a foreign workernot because hes cheaper but because he has better workplace skills and discipline. Thats the message Labor Secretary Elaine Chao hears from U.S. executives who are worried about Americas competitive future.
Beyond the cheaper cost of labor, U.S. employers say that many workers abroad simply have a better attitude toward work. American employees must be punctual, dress appropriately and have good personal hygiene, says Chao. They need anger-management and conflict-resolution skills, and they have to be able to accept direction. Too many young people bristle when a supervisor asks them to do something.
As for our job future, Chao notes that most of the fastest-growing jobs today are in industries requiring advanced knowledge and skills and are very high or high wage.

Aghast...... Can this happen? I think they have to return the application filing fees. Has any one else heard about this.
USCIS cannot keep the filing fees if they return your application. They can only keep it if they do accept it and then deny/reject your application.

I am not talking like anyone, just expressing my views. Please refrain your self from pointing fingers to any member. I did not come through a consulting company, hope this makes you happy.
mr Ganduteli please dont make comments on either visa status, my wife or any substitute labor as none of them apply to my case.
likewise please do not generalize any working type or business which is legally allowed to operate in US just because you are not working for that.
Please restrain from posting anything negative which will not help anybody.

For me 24 days passed I've not received any letter from USCIS.
I have received an email yesterday saying my previous approved H-1B has been reopened on 11/15/2007, and they sent out a notification letter in post, I am very eager to know the status of others who has already met the 30 day period. Please provide some feedback on your case status.

A desi consulting company brought him to the US. When they realized he wasn't going to get a project, they just didn't let go of him. Since he was a reliable guy (1. he can be trusted with monthly grocery payment 2. his labor can be sold later to others 3. he servres as an insider who can get information if other consultants are trying to be sneaky by getting their resumes marketed by another company, etc etc, basically he is an asset even thought he doesn't have a project), they just decided to keep him there. These companies don't have attorneys. They take care of all legal matters themselves. Now, how much is hte USCIS fee to file for labor? How much to file for I-140? Peanuts right? So they continue to keep his application active. How hard do you think it is to get fake references when you can make fake resumes. They have fake pay stubs. Fake experience. Fake this and fake that. Everything they do is fake.
So to others who have said that this thread has to be dropped, and have said that these desi companies are right in doing what they're doing, or who have blamed the system - I think that you are one of those people who are involved in such a racket. I know that I have touched your nerves by letting the whole world about this (not that some people didn't know this already). Why else would you want this thread dropped?
unbelievable is all i can say. i just hope that there are not too many cooks around. but the truth is that this is a racket and busting these rackets will actually reduce retrogression.

When I called Lucille Raybal Allard's office last week, a rep from the office had an extensive conversation with me about both the bills and they have not heard about them before. He recognized me when I called him back to check if they made a decision.
Alright Folks, Let us not get distracted. We have lots of work to do.
what was the decision though? not trying to question your calling but just curious on effectiveness.....
the fact that the person remembered you does not mean anything.....say, i run a hardware shop and have not sold a mousetrap in months - suddenly 3 people come in asking for a mousetrap - despite the fact that i probably get hundreds of customers - chances are i would remember those 3

I am not a chartist or day trader if that is what you want to know. I have worked in high frequency Stat-Arb trading which also does micro caps sometimes.
smisachu,
Where can one learn about high frequency trading ? Can you suggest books that mathematically model various instruments price movements such as stocks, options and futures ?
Thanks in Advance!

I don't agree with your comment.
Probably it is demoralizing to many. I had written many times., let's not drag individual instances , subjective feelings into a forum discussion which is general in nature.
Here we are not talking, something like, do you believe in god? The thread is 'Are we ...'
Yes, our success has created these issues for us. We are sincere, talented, educated, skilled and experienced. In my view, three things perpetuate this:
- this republican regime, the way its runs government (hence throw the bums out)
- lack of interest in our issues by our predecessors who have GC in their hand, our community leaders
- general introvert nature of Asians(aloof, not interested, not outgoing, not mixing, not greeting etc)
There is one more thing that not many people are aware of.
Let me ask eveybody. Even after all this, why are these Desi consulting companys successful in the market? They have poor quality product (People with forged Resume), they are not charging lower rates, but still they are able to put there people in Projects?

AFAIK, the GC job has to be a permanent full-time position and not a part-time position.
So much pain we are facing in this process. Hope all see their GCs come through fast.
My attoreny said GC is for full time position and it is very well supported if the employee is working full time with the sponsoring employer. I can easily imagine getting it filed in 3-4 places working part time or not even working. I guess we can run into problems if working part time. There is also a column somewhere in H1B visa application form where they ask "Did anyone sponsor you an immigrant visa". Not sure if that Question comes anywhere in the forms for GC, but if so, what does one write? A list of other employers.May not be a good idea, but its my personal opinion, and I dont have any observation on this

While I was waiting for GC, I finished MBA last year. I have a Masters degree in Comp. Sc. also. It has been 4 1/2 years with no clear indication regarding the LC alone. Hats off to the screwed up concept of BEC. If my LC is not processed in time, I might leave next year.
I am thinking of doing a part time job on H-1B also. If that pans out well, atleast I will forget the pain of GC for a while.
