Good to know, thanks. Maybe we were reading different threads :) One thing though, because of the heavy rush of citizenship filing in 2007, combined with the election-year pressure of 2008, petitions were fast-tracked in recent years. There are so many confounding factors, anything is possible.
I can attest to this as well, I know couple of close friends one in NJ area and one in Bay Area CA both of whom got naturalized in 3-5 months time frame. This occurred in the last 2 months so this is fresh data. In both cases the N400 app was approved within 3 months of filing..And the interview was a month later after the approval. Again i just know these 2 guys so my data spread is limited. On other hand i dont know anybody in my circle waiting for a long time on N400.

Couldn't agree more. The problem lies here in the US..Just pure politics...The cost of education is just too high for an american to get a degree whereas a foreign born is able to get it for cheap. Politicians know it and they want to keep it that way. America will just do fine with or without you.

Lets not support this bill guys. The right way to stop mis-use of H1 or L1 by companies is to make it a free market for the "employees" in visa. Let them be able to work for "any employer". Do you think the L1 guy will let him be abused, if he was allowed to change employers easily. Lets not close the doors for others, lets have an open mind to for competition and equal human treatment. Also lets see what is best for USA.
Putting more restrictions on employer is never effective. Abusing employers will always find the loopholes, and the legitimate employers will be scared away. The effective way is to get the "visa employees" more freedom.

I also got email from CRIS last night stating that my I-129 has been reopened.
I have a very simple immigration history:
I-129 filed and approved April 2005, petition expires 3/30/2008; only ever worked for this same company.
No H-1B extensions ever filed, no H-1B transfers ever done, no previous history of US immigration prior to April 2005.
Labor, I-140 and I-485 were filed November 2006; I-140 approved February 2007, I-485 approved June 2007, EB2 green card arrived June 2007.
There was a LUD on the I-140, in August, but that was about the same time as a bunch of other people got LUDs on cases starting SRC07... seems like I can disregard that.
There was also a LUD on the I-129 without a status change later in August. No explanation for that was apparent.
And now I get a notice on 10/23/2007 saying that the I-129 has been re-opened and that something will happen within the next 30 days. I'll be sure to keep you all updated if I get anything like an actual I-797 notice through the mail.

So you made the problem statement which every one around here knows. What are your action items for poor souls like me who do not know how to take on, a person with successful TV show , using a placard and a megaphone ? What would be your solution ?
I think WD already posted the action items - questioning the radio shows fairness and if they feel they have a responsibility in not inciting hate crimes toward immigrants both of which are very good points to raise. Lou Dobbs already has a huge platform from which he is spewing venom on immigrants and the last thing he needs is another medium - radio - to carry it even more.
GC is a pre-req to becoming a citizen and once you become one it is hoped that you would voice your opposition even more against hate-mongers like Lou. What he is indulging in is despicable - using the average American's economic insecurity and playing it off againts immigrants - & one does need to speak out if not for yourself atleast for others that can't do it themselves so WD is doing the right thing urging people to call in.

Most of the Congressman offices are now well aware of the issues, phone campaign is not an attempt to explain them the details.
It is more of a push for them to take action by giving them a sense of how frustrated we are. Not many "normal" people would just pick up the phone and call a congressman, right?
While clicking a mouse button takes a fraction of a second, you would have to spend atleast a few minutes picking up your phone, have enough belief in your issue to have the courage to speak to a live person and convey your message.

There is a rumor going around now. One of my colleagues here claims that he got a call from his attorney that there is going to be a new bulletin for july, released either tomorrow or on Monday. Can someone talk to their attorney and confirm this?
I'm unable to reach my attorney now.
Nobody knows anything - this is just a rumor for now. Though I love to see it be true, I dont think it will happen. Re-reversing the visa bulletin will get more attention than the original reversing and USCIS might try to avoid that. But after JULY 2nd I wont get surprised with anything now (regarding visa bulletins and USCIS's stupidity).

don't forget to file change of address AR11 if you move. People tend to forget this since after getting GC there is very little or no paper work required unlike people who are waiting like me:).

The following are clear cut abuses.
I want to give some fraud and abuse examples. Unfortunately, there are some bad apples in the H-1B visa program.
In 2005, a man was charged with fraud and misuse of visas, money laundering, and mail fraud for his participation in a multistate scam to smuggle Indian and Pakistani nationals into the United States with fraudulently obtained H-1B visas. The man created fictitious companies, often renting only a cubicle simply to have a mailing address. He fabricated tax returns and submitted over 1,000 false visa petitions.
Another man pled guilty last August to charges of fraud and conspiracy. This man and an attorney charged foreign nationals thousands of dollars to fraudulently obtain H-1B visas. He provided false documents to substantiate their H-1B petitions.
Also, an Indian outsourcing company was fined by DOL for paying lower wages. Another example of clear cut fraud.
I am also anxiously awaiting this report.
The U.S. Citizenship and Immigration Service is also worried about fraud in the program. This agency's investigative arm, that subdivision called the Fraud Detection and National Security unit, is doing a fraud assessment of the H-1B and L visa programs. I asked the unit to brief my staff on their work, and they reported they are not finished with analyzing the data. Senator Collins of Maine and I put the agency on notice that we are anxiously awaiting this report so we may continue our quest to reform the program appropriately.
The questions are
What is a fraud?
How will yo detect a fraud?
How many companies are commiting fraud?
How many workers are involved in fraud?
Remember, they are not interested in benefit for worker. That is, something that is a problem for worker (kind of issues mentioned in this thread) are not of interest to them.

I agree with all you folks that we should not just be happy and end our fight here after getting EAD etc...
We should try to push it back to the government as why legal immigrants from india have only 9800 visa every year...its unjust for a country as big as india and havin so many hitech workers....
On todays 7/18/07 NPR news, a USCIS spokesperson has mentioned that USCIS has made a note of the recent protests by legal immigrants(flowers and rally)....NPR also has mentioned this website also....it is a big achievement for us and we should pursue till the final step...check out the link below.....

eb3_nepa's request is valid in the context that spouse of an L1 can take up any Job.. & the spouse of the proposed 'Blue Card" can take up any job.. why not a H4?

1) You ignored the point people have life and do things to be happy in life. You choose a job that makes you happy. Then apply for GC either EB3 or EB2.
You say you have chosen PHD, and you came out low on money. What were you smoking when you chose Phd and also thought you would make money?
2) I cannot change my classification and port it like it is my application. Because simply it is not. At the same time I do not want to leave my 6 figure job with benefits ( yeah you heard it right and damn right I worked hard for it like you did for your Phd)
And yeah India is a great country and would love to go back someday, but not today. Irony is I know for a fact that I will have better life in India than in US given my family background. But I will not let any struggle in my life go waste.
PS: I have a US Masters with a 4.0. I have got offers for Phd which I chose not to do because it does not interest me.

My point is Don't crib if EB3 is retrogressed...use the system and become EB2, port your priority date, which is ofcourse dependent upon finding an EB2 job !!! All of this nonsense .."i pray someone does something for EB3" is going to get no one anywhere !! Fight for comprehensive immigration reform or HR 5882 recapture BUT for god's sake Do not blame the EB2 - India people who have played by the rules and are in a favorable position today relative to EB3 !!
The lawsuit against PD porting makes sense from an EB2 perspective and they are right to go ahead with it. Porting your PD from EB3 to EB2 makes sense from an EB3 perspective and every EB3 should try to do it before this door closes, if it does.
