You raise a very valid point.It is not as if these consulting companies are subsidised by the US govt to provide welfare to poorly qualified aliens - these companies are surviving and thriving in a free economy.This tells me that either (a) these consulting companies do a good job for their customers, despite the "cooks", "maids" and "servants" posing as software engineers or (b) There is a large enough demand for these skills that the clients cannot find enough qualified locals to hire on a full-time basis; hence go in for these "body shops".
Now, the unfair practises that these consulting companies indulge in are legendary - I am not here to defend them. All I am saying is there is an economic vacuum somewhere that is being filled by these body shops - something that Dobbs-ian minded folks will not acknowledge. Ands lets face it, a lot of our spouses on H4 would not have been able to work if not for these desi companies willing to sponsor an H1. Now whose fault is it that in 21st century america there are laws that condemn these people to staying indoors ?

You needn't have a rejection to be part of the lawsuit.
You can pretty much rely on their revised bulletin and convince the court that your application was/will be rejected and be part of the lawsuit.
I guess USCIS is getting pretty smart. To be a plaintiff in the lawsuit, your application has to get rejected. By holding your application, it is probably preventing you to be a plaintiff. Smart F***ing A**es

If there is a software designed by us, totally the system may collapse ;)i seriously doubt if the folks out there in uscis analyse the way we do here in these forums. think for a minute... if they work so sincerely and intelligently, they wouldnt be working for 20$/hr. wish there were performance based payment schemes for these folks.

I wasn't the lucky July filer, I am sure their are others like me waiting.
DO a rally and I will be there with contributions, do something big, I am sure more like will join the cause. Not a free rider but at the same time don't like to be taken for a free ride!

How about trying to convert the existing "free" members to paid members? People post questions here all the time asking about personal stuff. People can be allowed to register for free but for posting we need full details In the very least we need a VALID phone number and a VALID email. For this we do not need IV teams to do anything. If, as a surfer you want to post or get access to "members only" posts, the surfer has to call the IV phone number using his primary phone number. That whoever is answering the phones can verify the phone numbers. Once the phone number is verified, the status of that member will be "active".
Now the team responsible for collections can start calling the people and asking if they have contributed and how much. We are looking to get more members and that is a wonderful approach. However we have only a THIRD of the members paying over and over again as it seems from the previous posts. It's time to start converting the free members to paid subscriptions. These other 2/3rds are using IV bandwidth and resources. It's time people started paying their dues. Doesnt have to be $100 minimum, even $10 will do, but please contribute. :)

One thing is true that life is not fair and USCIS is even more so....it is hard for us who are mostly engineers and scientists out here who always try to seek logic get totally flummoxed by USCIS.
I will keep on calling them and every time I hear a new thing.
We have to be patient..I guess it gets darkest before it is dawn...

IV has to priorotize before going to a lobbyist, with very very few contributions made, its very difficult to have everything bundled into a single request.
Its also unfair that L1 has to work for specific company but L1 spouces can work for any company any job, its so funny, when you think H1 has to work for specfic company and only for specfic job, but spouces can work for any compnay any job any salary without any labor department intervention
Immmigration awareness has increased a lot among US voters, when it comes to threat of their jobs being lost, and democratic senators are very much aware of it, hence CIR is no longer their priority.
I am not fighting but YES, my reason to join IV was to find justice to the H-4 not being able to work when L-1 spouses and Agjob spouses (I read this a year ago) could. Although no promises were made from IV, I was surpired today since nothing was ever said regarding no interest in the H-4 cause when many discussion were in place. Here people contribute for their own benefits, I was here for the H-4s, that is why I transcribed part of the conference calls too, so I was somehow a contributer to a cause that doesn't represnt my interests, but I know it represents the interests of the unmarried folks, or married to IT spouses folks.

In my opinion USCIS will not give inaccurate information, in writing, to a Senator. The letter clearly mentions 'Application Pending for India'...
USCIS might not have intentionally given any incorrect information. Perhaps to them what they sent means "EB applications pending for India". Key part is "for India", which quite likely does not mean chargeable to India.
I doubt if they can easily track out applications chargeable to India that easily (even if $5K is sent to them). Whatever is entered in the system when USCIS receives paper applications (e.g. name, address, date received, category, date I-140 approved, etc.) can only be used as a criteria for queries. Birth country perhaps is only on paper application, and is verified for approrpriate chargeability at adjudication time. Systems are not designed for handling cases where country of chargeability is, as is the case for us, the final stopper.

Hello,
Here is my case trail
worked with employer A from June 2005 on h1b visa.
Employer A applied for GC under PERM EB2 with PD - March, 2nd 2006 - labor approved in a couple of weeks
Employer A applied for i 140 in June 2006 and got approved in July 2006
Filed for i 485 in July 2008 never received FP notices
Project got over in last week of February 2008 and unable to find new project.
I switched jobs in last week of April 2008 using EAD - using AC21
Sent AC21 letter to USCIS in July 2008 about job change.
Employer A requested 140 revoke in August 2008.
Spouse got FP notice in August 2008 whereas I (primary) got NOID asking for new employment details.
Responded to NOID in a timely manner and on August 25th, 2008 - my status changed to "Response received - case processing resumed"
In Jan 2009 I got my FP notice.
In Jan 2009 - I travelled using AP and got back fine.
In March 2009 - I got a denial notice saying "485 is denied because 140 was revoked on August 2008. No appeal only MTR" - thisletter comes from a different officer id than the one who sent the NOID.
My question to UN and other gurus. Does it have anything to do with a changed interpretation? My lawyer says "This is a training issue - the new officer did not know about AC21 and as soon as he/she saw 140 as revoked - just ignored your other details on the case and issued a denial notice. This is very common and can be resolved using MTR"
Your lawyer is probably correct. This has to do with IO who are not aware of AC21 laws. But make sure your employer did not have any issues with DOL, USCIS in responding to RFEs related to other employees like H1 RFE, ability to pay , etc which may be used against your application.

Thats irony, people with 2004 PD got their GC last year when 2001 is still waiting.
in year 2007 EB-3 india got 17,000 green cards, still not enough to take care of the high demand. there are just too many people waiting, that's the fact and nobody can do anything about it...except for supporting IV for these three bills...

You are right..it takes time and effort, and money too. We are ready to donate, if we are allowed to file EAD after 140 clearance immeditely, ,irrespective of EB-2 or EB-3. However, do not reply saying that you need to donate first as this is not how we think. There are a whole bunch of friends who are of the same opinion.

As the guy who posted it said, this is a normal process....Consulates will know 3 to 4 days before...
That is correct, 9 months and then I will return to my country for good.
I am waiting for the day when we get the GC , we will tear it into pieces and throw in front of consulate.
