A bill that would give millions of illegal aliens in the United States the opportunity to earn citizenship is closer to becoming law today as members of the Senate Judiciary Committee signaled likely passage of a proposal by Sens. Edward Kenney, D-Mass., and John McCain, R-Ariz.
Though a committee vote will not be held until after a week-long congressional recess, likely March 27, committee members appeared ready to back the Kennedy-McCain bill.
"The votes are there," said Sen. Charles Grassley, R-Iowa.
Congress is working to pass a reform bill that includes enforcement, a policy on dealing with illegals already in the country and a guest-worker program pushed by President Bush.
Under the legislation, illegal aliens in the United States would obtain six-year nonimmigrant visas under which they could work in the country and travel outside the country. The aliens would have to pay a $1,000 fine and undergo background checks.
After six years, the aliens would be able to meet certain requirements and then apply for a green card, or permanent residency.
Besides voting on the bill after the recess, committee Chairman Arlen Specter, R-Pa., said the panel also would vote on a bill by Sens. John Cornyn, R-Texas, and Jon Kyl, R-Ariz., that would give illegal aliens up to five years to leave the U.S. After returning home, they could then apply to return, either as temporary workers or for permanent residency.
"Our intention is not to strand anyone outside the country," Kyl said, according to an AP report. But he asserted the McCain-Kennedy plan would give an illegal alien allowed to stay and work in the country a "huge advantage" over a person having to wait for years in his or her own country for a green card.
The McCain-Kennedy bill would start off with offering 400,000 of the new visas.
Two years ago, Bush proposed a guest-worker program that has been criticized by immigration-reform advocates as nothing more than an amnesty program for foreigners who entered the United States illegally.
Kennedy disputed the amnesty charge: "There is no moving to the front of the line, there is no free ticket. This is not amnesty."
Majority Leader Bill Frist has threatened to bring his own immigration bill to the floor of the Senate March 27 if the committee has not approved one.

Not sure if there will be any response. Even if there is one, they are going to say that my dates are outside the processing times.
Receipt date: July 9th, 2007
Priority Date: July 19, 2001. EB3. India.
What reason can I write for "Description of your case problem"?
Can I just mention that I am about to incur significant and unusual costs because of this delay?...

Description of problem has to be something suggesting that they are not following their own rules. Mentioning about significant costs etc is not going to fly as that applies to everybody. If Ombudsman believes that your problem is genuine, they send case to the processing center for an answer within 45 days.
Processing Centers claim that they process cases in order they receive. If you know any case (even from this forum) with RD after your RD, which has been processed, write it there, asking them why your case was left out. "The DOL Perm rule, at 20 CFR 656.32 provides for the revocation of approved labor certifications by DOL if a subsequent finding is made that the certification was not justified. In such instances, DOL provides notice to the employer in the form of a Notice of Intent to Revoke an approved labor certification that contains a detailed statement of the grounds for the revocation and the time period allowed for the employer's rebuttal. The employer may submit evidence in rebuttal within 30 days of receipt of the notice. If rebuttal evidence is not filed by the employer, the Notice of Intent to Revoke becomes the final decision of the Secretary. If the employer files rebuttal evidence and DOL determines the certification should nonetheless be revoked, the employer may file an appeal under 20 CFR 656.26 within 30 days of the date of the adverse determination. If the labor certification is revoked, DOL will also send a copy of the notification to USCIS and the Department of State."

No transit visa required. I got an identical response when I checked with the german consulate in november. Nevertheless, I did not take transit visa, and with visa stamping expired in March 2010, I travelled with AP on Lufthansa from IAD to BLR in December, and returned in Jan 2011, and nobody even mentioned the word "transit" anywhere along the route. Lufthansa staff is very knowledgeable about AP, both in Wash.Dulles and BLR. In fact, In BLR I saw that even Air France also does not require transit visa for Paris and allowed people with AP to board without transit visa. So folks, dont waste time and money on transit visa. Nothing is going to happen , unless you miss your connecting flight in Frankfurt, in which case you will not get to stay in a hotel and would have to spend the transit time in the airport.

This is new rule implemented and by thinking you as senior if someone goes and faces problem will you be responsible. So please don't do this boss.

This exception is meant for persons travelling to the US holding a valid US-visa (e.g. a visitors visa with one entry) on their way travelling to the US (Exception 1) and travelling back to their home country during the validity dates of this same visa, but already having used it for entering the US (Exception2) . I hope this clarifies your additional question. I suggest that you apply for an Airport Transit Visa as soon as possible to avoid any problems when travelling back to India via Frankfurt airport.

It used to before but no longer and of course France, England and other countres never did. So coming back to Germany yes while travelling to and fro you need a transit visa (Direction does not make any difference because as far as Germany is concerned you are from India and you have no Valid visa to America and/or any european country so you are suspect of trying to illegally enter Germany and to avioid it you need to buy transit visa).
I myself was plannig for a trip and was trying for travle via Doha and Qatar where no transit visa is required. (Us to gluf direct flight. Gulf to any city in india) but the rates were high. If you like you can look at that opiton too. beats the hell out of going to teh german embassy and getting a transit visa. But if that is your preference go with it

I think worrying a lot about the GC has increased my blood pressure (and I need to relax). :) It is just like the COLTS disease - men are made to worry about the future. ;) IV allows to share your pain with others and also work together for a cause.

The bill states failing to show evidence of your immigrant status, is a misdemeanor and will result an arrest. So this is going to trouble a lot legal residents to prove they are legal and there will be a lot of litigation as a result of this.

Let us see if we can get at least 200 people who vote on this. Many the great souls are talking about complaining to USCIS about EB1s getting GCs using shortcuts. Some of them suggested LET US write to ombudsman office and USCIS & blah blah. Let us see how many folks come forward and vote for this.

I didn’t want to go to DC rally due to my surgery appointment (September 6th) because I can not fly for three weeks after the surgery.
Guess what?, I have postponed my surgery appointment date, booked tickets and going to DC rally on Monday evening and flying back on Tuesday night.

Hi Guys,
After a long journey of more than Sixteen years in this country, I finally received my GC.
In short, I came in 1993 on J-1 for my training which took six years, followed by one year on O-1 visa and then J-1 waiver for three and half years in underserved area. Then applied for labor certification in Oct, 2003 EB2, through university, which was approved and then retrogressed. Applied Schedule IIA, approved but also got retrogressed. Got AILA liaison and Senetor involved.
Applied for EB1 and NIW in July 2008.
My lawyer was very much involved in the whole process, was very helpful at every step, and wrote letters to USCIS.
Finally, GC came in April, 2009 and received the cards one week later. My PD Oct 2003.
During these time, I actually had no problmes at my job or my my wife's job. Brought a house four years ago.
The main problems were:
Daughter and son could not apply to state colleges/ medical colleges. (daughter going to med school next month)
Got stuck in India for renew of H-1 for 2 months!!! (worst time of my life, with my wife and kids in US) I tied every thing from writing letters to calling Ambasador. Not effective.
Could not go to certain occasions, like death of very close family members, weddings etc.
However, I kept my cool and prayed and got lot of support from Immigration voice.
As a small token of appreciation, I am donating $500 .(and will keep on supporting)
We all are going to get GC, some sooner some later. Just keep on doing you job.

Financially, most economoists are predicting that east bay market is bound to fall further. (I would not discount the opinion of CNN Money easily).
That having been said, I agree that living in a house is definitely more about feeling than about finances.
How does someone know when is the right time to buy a home? Anytime is a good time to buy a home, as long as you can afford it. I thought the last few months were good time for buyers because of the inventory situation (more choices or otherwise you bid usually in CA) - I dont think anyone can predict the market situation in 5 years and no one makes money in 2 years in a good market condition as well. I bought it 2 months ago in East bay and I am planning to hold it for another five years atleast and both spouse and I work - it is certainly not an investment for us, rather a place that we live - it is a rare feeling one gets after living in exile (apartments)
