After talking to my lawyer, I have decided to forego my H1B renewal and instead move to EAD. This allows me the flexibility to move to better roles with my current employer, as well as other employers.
As has been mentioned on some other threads, the most common reasons for your I-485 denial (fraud, out of status, communicable disease, criminal or felon etc.) would probably also mean that you are ineligible for an H1B too. As long as you are confident that you do not fall into any of these categories, the risk is very minimal.

If you are filing on 1st July then you shud not leave US till you get your receipt notice. With the current processing timelines it is very unlikely that you will get your receipt notice b4 20th July. So hold on till 14th July for next visa-bulletin. If dates are current even in Aug, which is most likely the case, then do your filing in August, else return back b4 July end and file 485

sure I am .. and guess what my dependents were already approved few weeks back on my EB2.
and yesterday my EB1 I-140 was approved :D:D:D:D
But my fight for what is fair is distinct from my own case and i am gonna keep going.
Bcoz Mr. gctest is Mr. phd, he treats Eb3 with contempt! Now, he will go back and delete all his dirty posts :)
EB3 can accomplish anything that EB2 can, based on their work experience, but some people don't understand that.

its a short sighted approach, you will just move from one level of pain to another one...once you realize that you are stuck with no change in job 'status' for 10 odd years you will realize that AC21 is not all that great...ihmo..i agree with you on the SKILL bill
I agree with you guys...especially even if they permit 485 filing pending the priority date...it will help a whole lot of people get out of their employer's tyrannical grip and lead a free life.....:) ...I only hope the SKIL bill gets passed in some way sooner.....

But from what I understand, a lot of people still don't know about IV and we must make more attempts to spread the word. Many people just don't know or understand the concept of IV. When we want them to join, the get suspecious and cautious and stay away. The idea here is to reach more and more people. IV is better organized now than what it was before and as people start to realise, they will come forward. Remember, IV is a concept and a platform andwill always stay. people may come and go - there will always be people motivated at different levels.

Ok. I agree with everything you say but you still haven't explained why EB-2 China hasn't moved. They never were Unavailable, which means they haven't used their quota but are still retrogressed. Why absolutely no relief for them? Not even a month forward movement?

Maybe over this month (March) the usage of EB-2 China was so high that they were at the verge of U or maybe something like 12/01/2002. So now when the excess EB-2 visas from ROW are getting spilled over to oversubscribed countries, i.e., China and India, both of them are and will be, going forward, moving at the same pace.
As I said just a theory. Let's wait for a better explanation.

-- Involved in a collision few months back. As I had rear ended the vehicle, as per the investigation, it was found it was my fault(80% mine - 20% others)
-- Now after more than 18 months, I get a law suit for 3.25 million dollars(. This was served against ppl who were involved. Right now my I have my EAD and AP and maintaining H1 status.
So what are my options now?
1. Check with attorney and start defending..?
2. pack the bags and go back to my country ? If so, will there be any issues in coming back again, say after 3,4 years?
3. What about my GC?
Any help would be greatly appreciated and I guess it would be a biggest decision of my life ..

What is confusing is that in the notice of intent to deny; uscis officer stated that person may be eligible for ac21 and to give a job letter.
The only thing I can think of is that there may have been something wrong with the I-140 (ie., too many cases file by the 140 company and company revoked it in response to an ability to pay query, etc.).
This particular company is pretty large staffing company. i do not have any interaction with them but from what I know; they have been cancelling a lot of people's h-1b's and telling them to find other employers to transfer to. Don't know if there is a story within a story.

I had the same kind of situation . I work for a Fortune 5 company . The prevailing wage some how came to $5000 more than the salary than the company pays me ( I think I am pretty competitively paid ) . Our attorney team told me that this is nothing to worry about . The wage difference actually matters when your I-485 is filed and about to be approved . So you could actually go ahead and file the labor and get the I140 approved and wait for your wage to rise to the levels ( you will have to wait anyhow for a few years ).So if I have to wait for like 3 years for my GC my wage will surely rise to USD 5000 in 3 years . Also remember that the total wage is the sum Salary + Joining bonus + awards + yearly bonus . So you could add these things to give your total wage .

Logiclife. I know why you are responding to these comments you all are frustrated with such comments. I know it is hard to not respond but please ignore these asinine comments. Please have some of these comments linked to the main page. But believe me "barking dogs seldom bite." Such people will ultimately sap your energy. But, just like how IV is asking people to contribute please also ask them to use their own judgment, they do this at their own risk. Jesus! That looks sooo risky. Yes indeed my PD is May 06. Now the question is what if (I know a big IF), but what if, I apply for my 485 (hoping that my 485 will be on EAD/AP for a long time) BUT my 485 gets approved rather quickly and I am not able to marry before that happens -- do I have *any* way to tackle that issue? Or would it then mean that my wife cannot come in US for n number of years after marriage?!
