just came back from india via frankfurt using AP. no h1b in passport. no questions asked, no one even verified AP. so, i can confirm that, i just came back 10 days ago. hope this helps. Took lufthansa.

I know after we file the i-485 for 180 days, we can change our jobs. But rule is that the new job should be in the same field as the old one.
Can i change my job from a biological researcher to a biostatistician? My current job is in the field of biology, which involves lots of experiments. If I change my job to a biostatistician, which is like a programmer, do i still qualify the "similar filed" rule? thanks for your help!
biostatistician job position can involve analysis of biological data. That qualifies you still as a biological researcher. Biological researcher is a very very very broad term working from bacteria to human genetic diseases; deep sea fish to suspected life forms in asteroids and space debri (astrobiology). It is basically a straightforward description of what you are going to do as a biostatistician and justification of how this will still qualify you as a biological researcher. That makes it very much job specific: if you are going to use statistical methods to analyze GE's cat scanner machine performace it would not be biological research, but if you are going to use some statistical methods in analyzing cat scanned body images and tie your analysis to clinical conditions it would. If you could post both your current job description in your gc application and the prospective biostatistican job description as you see, I can try to help you.

Believe it or not, I was about to open a thread like this. And here is the worst part, my AP has been approved 10 days ago, and so far neither the online status changed to approved nor i have received the approval copy. 2 ways I found out my AP was approved was through my local congressman and I took an infopass appointment. In the info pass appointment when I asked what is causing the delay in sending an approved AP, the officer says, if you did not get the approval notice in 45 days, call us back. This after waiting for more than 90days from the date of application. So, its not there until you have it in hand. Merely getting an approval these days is not enough, since they take anywhere upto 45 days to send the approval to you.

My wife's EAD card was delayed beyond 90 days. I called USCIS 3 times and they did the service request, but told us we would have to wait 45 more days. At the 96 day mark, I quickly filled out requests for my senators office to get involved and they helped out. EAD was in mail the next week.

Hi,
I have a three year bachelor degree + MBA from India with 9 years of experience. My labor was filed requiring Masters degree + 3 year experience with no mention of bachelors degree. Last week, I received I-140 decline (I-140 filed under EB2) citing that my bachelors degree is only three years.
My company is planning to file an MTR with appeal citing 1) My labor only required Masters degree with three years experience and that I have the Masters degree with three years 2) I have bachelors degree equivalent with 3 year bachelors degree and 2 year experience equated to 1 year education equating to US 4 year bachelors degree.
Do you think my appeal would have a chance of success? Please let me know your opinion. I have to file an appeal in next few days. Thanks for your help.

I received a soft lud on my H1B approved in Nov 2007. All other cases do not have any LUD. I guess it is just the system touching these records as routine maintainence.
but I got soft LUD's on all my cases after using AC21.
Here two things happened

Lou Dobbs is playing to the galleries. The galleries are filled with people like him who are waiting for the sound bytes. The frenzy will keep increasing until it reaches crescendo like the NAZI campaigns. So we need to direct part of our media campaign towards stopping these lies. The only way we will get out coverage is to go out against the big ones and make the noise. We need to get all the ravings of Lou against the legal immigrants every sound byte , every word he uttered against legal tax paying wannabe immigrants( no nationality restrictions). If all of us unite and make a move against him it will make CNN see reason or Lou to talk facts and not the fiction he talks about us.

Irrespective of the immigration impact and its direct effect on me, I have tried analyzing the situation at the macro level and I end up at the same conclusion.
Health care, immigration, social security insolvency etc. no one cares about anything. Companies want to bring skilled labor in and it is being decided by a lottery!! I mean give me a God damn break. In the supposedly knowledge-driven economy, skilled workers are being selected by a lottery!
Medical emergencies are the leading cause of bankruptcy and there is just talk on the issue, no action.
Farms are shutting down and moving operations to Mexico. So now the oil will come from Middle East, manufactured goods from China and food from Mexico. And people are Ok with that because "companies just need to pay higher wages to *American* workers" So on top of $ 4 /gallon gas, we will be paying $ 8 for tomatoes.
There are not the marks of a prospering or forward-looking nation. May be I am becoming cynical as I grow older and may be things are no better in other countries like Canada, UK etc. But sometimes I feel as if I am watching a bad comedy show in slow motion. I question myself if my son, a US citizen by birth, will end up growing in a 2nd world country.
America was built by immigrants who came here with no sense of entitlement...just hope.....whether it was the Jamestown settlers....the Bavarian farmers....the Irish escaping the potato famine....the East Europeans fleeing communism.....and the recent Indian, Chinese, Japanese and other Asian populations looking to escape corruption and nepotism back home....
I fail to see how people these days forget this....one of my good friends acknowledges that his grandparents came as refugees fleeing strife in Europe but at the same time curses immigrants for the current woes.....and this guy is not a racist....an entire generation has been brought up to use the i-word as the substitute for the n-word since that is now politically incorrect....:mad:
Like the Klan leaders of yesterday, the Lou Dobbs of today never desist in blaming the 'immigrants' for everything....:(
