    All this while we legal folks have been renewing our H1B's with overlapping time intervals so taht there is no Gaps....now that sounds like a stupid thing to have done....

    I don't think consulting firms are alone to be blamed.

    Lets say there are around 1000 consulting firms it the worst case there may be around 1500 firms which have a capacity to apply 15 H1B each.

    still the number would come around 15000 to 30000 but the big 4 companies in India got 20,000 H1B last year, which means they might have applied around 45000 to 55,000 applications

    my numbers may be bit off but i think Big 4 companies from India are doing more damage then consulting firms in US.


    Guys.. i'm sick of this nonsense.. I mean this is ridiculous.. this is my second go around in this stupid lottery.. last year I hadn't graduated so they put me in the bachelors quota.. this year the freaking masters quota is full.. i have a genuine offer from one of the big 4 accounting firms.. and have work experience to back it up

    i'm sick of these consultant firms.. i wish I could work for the uscis and weed out these miserable cheapsters.. 6 years toiling in their education system, paying the damn taxes, and waiting for 1 smart person to come along and tell them its time to take care of these consultant companies and their consultants who get the jobs based on deceit and conmanship..

    simple non sense.. random selection .. my behind..

    I really feel like sending flowers to the uscis similar to what the indian folks did last year..

    I think these memos might have been dissected a thousand times, but here they are:

    It's clear that the stress is on "intent". If at the filing of I-485, both the employer and the employee had the intent, it's fine. The only restriction is, one may not be looking for "same or similar" job at the time of I-485 adjudication. Why this restriction is even there is beyond me. It doesn't clearly state how much time after the adjudication, you should not be looking.

    Of course, the lawyers seem to be on the cautious side. Read the last sentence under intent in the following site (AC21: Changing employer while waiting for pending adjustment of status (http://www..com/greencard/adjustmentofstatus/changing-employer.html) ). It says that ...theoretically, USCIS might be able to revisit the adjudication of I-485 and initiate revocation processing.
    This inference is without any attribution.

    Then again, I couldn't find a single case where the I-485 was revoked because of suspected fraud in "Intent". We do need clarification from USCIS on this.

    I dont think so. I believe that EB3 I would get the bare minimum they should get in a year if not more.

    I am not tracking approvals rate as such. But if, CIS hasn't used as many numbers have DOS reported, then as Ron suggested, dates will move forward for EB3 Ind.


    1) Ron did not say that very few EB3-Ind approvals.
    2) Why should EB3-Ind get less approvals?
    3) If USCIS approved less, why did DOS state that visas are used up already? that is the point here
    4) Is there any discrepancy between USCIS and DOS??
    5) Is this something Immigration community can look into?

    Even if PD is not current, I believe you can convert CP to AOS. Check Murthy website or talk to them.

    If this cannot happen for you then you should look for a change towards this provision.

    But EAD & AP fro CP is not going to fly administratively. As others have stated it is contradictory.


    Guys let's come together on this--everyone has some good points to share, from every angle. As a CP filer myself, I want to say that job stability concerns are very valid for CP filers, who are haunted by last summer's greenlight and today's major retrogression. The landscape has changed for everyone, for both queues. From personal experience of being in the BEC backlog, being too early for PERM and too late for concurrent filing, after 5 years of being in this process and seeing the further backlog ahead, yes I was willing to pick CP (even though I would be giving up my ability to work as the spouse) because it looked like things were finally moving last summer. The option was there for people to choose, and nobody knew the dates would roll back so painfully again. Equally, I also want to point out that IV IS about everyone and these marvellous efforts IV continues to put together and inspiring in all of us, are beneficial to all because the overall goal is to ease the backlog which is holding everyone back. Now that this discussion has happened we are all aware of the new problem that is facing CP filers in severly retrogressed countries. And it is better that this is brought to light as we continue forward. Please everyone, continue supporting the letter campaign and let's be united and discuss these issues with respect for one another.

    congratulations..truly inspirational.. how did you acquire such phenominal emotional stamina?

    There were times when I was really depressed, specially when I got delayed in New Delhi with "Name clearance" for H-1 renew. However, I believed in higher power and never lost hope. My parents (mother US citizen,father GC) always kept my spirits high. I also got a lot of support at my job (when I got stuck in India, my chief pulled all strings possible to get me cleared).
    I also had a backup plan, where I could go to Canada or worst, can go back to India where I have an established practice.
    Botomline, do not loose hope and work hard.

    I have a pending AOS (I-485) application
    filed by my previous employer (company A). The I-140 is approved and is well
    past 180 days. I moved from company A to company B in late April
    2008. They did an H1 transfer and filed for AOS portability under
    AC21. I did not like the role there, so had planned a move to Company C, my current employer - again H1 transfer and AC21 (yet to
    be filed). Just before I moved, I got another offer from company D
    (which I believe best fits my long term career interests). I would've
    avoided the hop to company C had I not given the notice to leave at
    Company B. Now, I am looking to move to company D at the earliest (perhaps in a month). I have
    been at company C for 4 weeks now.

    Question:
    Should company C file an AC21? Since there is already an AC21 on file (by
    company B) and if I will move to company D, can I reduce one additional AC21
    filing? This is just so that there aren't 3 Ac21s filed and to avoid
    making me look frivolous. Please advice. If its safer to file it, I
    can request an AC21 filing soon from company C.

    I dont understand why we are hurt when 2 Indian companies were asked to detail how they used the nearly 20000 H1B visas they procured this time. DAMNN!!! IT IS VERY VERY IMP TO KNOW THAT. How many of these H1s are going to be brought here and sold to other companies, how much and WHO pays them etc.

    We are hurt because it's witch hunting. Nobody knows who applied for how many visas this year, but rumor has it that Microsoft was also near the top. Why not call them also?

    Do you realize how many biotech companies couldn't hire people this time just because these monsters gobbled up all the H1s:mad: :mad:

    That just means these "monsters" are more desperate to hire talented people than the companies you are talking about. Rationing is not an answer here. This is not a communist country. More supply is the answer.

    H1 is tailormade to boost the american economy and I firmly believe (just as any other country would wisely do) that the first preferance should be for US companies, OK.

    What is a US company? Infosys is listed here. Americans own stocks in most public companies around the world. US has no laws that discriminate against foreign companies. That's why US economy is still rated the most competitive in the world. You want to be more restrictive... What next? Get rid of inter state commerce laws?

    If the senators are wise, they will and they should, make it sure this time that this never happens in future. Regarding software, I firmly believe, as somebody mentioned earlier, that they also need to start small training centers everywhere. I dont say that there are not good professionals comming in, but believe me, all those so called mca, pgdca etc etc Man!! some of them even dont know the basics of computer!!

    Have you heard "market driven"? If I want to pay my janitor $100/hr why should I have to answer to anybody? Companies hire these people because they find them valuable assets. Who cares if they have mca, pgdca or kjshdj.

    Changing to vertical spillover will NOT help EB3 India or China. EB3 ROW is not current and it will suck up all overflow leaving EB2I, EB2C, EB3I and EB3C to their annual quota only. USCIS changing the process to horizontal spillover is the best thing that has happened to I and C community in the absence of immigration reform. Now there is at least some hope for EB3 folks to get a new job and apply in EB2, as at least that queue is faster. If we fight among ourselves and stop vertical spillover, it will only benefit EB3ROW as they will get all overflow from EB1 and EB2ROW. Please guys, let's not fight.
    you are from eb2 - I wonder what your opinion would have been if you were from eb3 - India ??? my feeling and hope is that they will start giving more spillover visas to eb3 categories - the reason being that they don't want too much gap between employment categories
    (eb2I date in 2007 while eb3 is still in 2001 does not look good)

    IMHO "legally" exploiting the system is illegal. I don't blame the system because any system will have some flaws in them. I would rather blame people who take advantage of situations esp in scenarios like this. We all know how much time some people has waited here. We heard a story on Monday right? Have we already forgot that? IV's goals and objectives are clear on its home page. Here comes the OP, registers himself and comes up with his first post of Labor substitution and how to better himself. I don't see any thing wrong in pete getting fired up. This exact attitude is the result of 6500 members and not 25,000 or what ever.

    If I was judging you I would have concluded that you support what the OP is doing and wouldn't asked you what your stand is. It depends on how you understand what I said. Those NASDAQ listed companies you were referring to might have substituted labors but I am sure they wouldn't charge X dollars for giving a better PD or deduct from payroll under some other miscellaneous stuff. I am aware of what you are talking and what OP is talking and they are not the same. I don't need to explicitly tell how desi shops work with
    pre-approved labor, esp in the current situation.
