Lets keep this thread to celebrate OP's Green Card and some inspiration for Hopeless EB-3 guys.
Krish: I agreed VISA recpature and not including dependents will help us a lot, but looking at the current political divisiveness and people focusing more on 2012 election cycle and the campaigning, noone going to touch this HOT POtato of legislative reforms for Legal immigration. Now considering wait until the formation of 113th US congress it is about 20 months time, so do u expect People who are qualified and getting an opportunity to get out of EB-3 mess should wait that long? People already waiting since 2002/2003 PDs and no sign of any legal relief from USCIS/DoS for this hopeless EB-3 india people. Once agian legit porting is the way out to come out of EB-3 india mess, their is no other solution for us. When you compare all retroigress classes EB-3 india is the worst, we are still in April 2002 as compared to other EB-3 categories which are now in July 2005 range. (china is exception to this they are way better than us to somewhere 2004 range). Please dont bring in this issue in this celebration thread, let people cheer something, we already had so many useless threads and verbal arguments on this subject.

I'm more of the opinion that White shirts and Denims should be fine. Suit in bay area makes no sense. We are all after all geeky engineers after all.. like some one said!

I do not appreciate you pretending to know what I think of everyone in here and their work. (Which just for the record I appreciate very much!)
Simply put: I did not and do not think of anyone in here as an idiot.
So please refrain from saying that in future.
However, if all you think of IV is as a message board and a bunch of idiots trying to fix things that may never get fixed, and if they do - you'll always stand to gain - a membership-based organization would better serve the needs of the rest, imho.

I work for a small growing company that is reporting losses for the last 2-3 years, but I still got my PERM and I-140 approved based on the fact that the company's asset value is way more than my salary.

I have an approved EB2 labor cert thru PERM, and I belong to ROW. I am now preparing to file I-140 and I-485 concurrently.
I just saw my petitioner's(S-corporation) federal tax return. Gross revenue is $700,000; Net income is $20,000 which is only a quarter of my current wage. The offered wage per my labor cert is $80,000.
Do I have a big chance of denial in the I-140 stage due to employer's inability to pay? Please advise.

It is important to do the homework and choose the school that fits your needs, if you want to get into finance or marketing or... go to a school that is know to be good in that field, you will still meet many people in other fields but the majority will be in the field you are interested on.
BusinessWeek website is good for reseach, but don't limit yourself to that.

Getting accepted is the most difficult part. Once you are in you can pretty much say you have the MBA. The GMAT is literally a pain, many of the questions are tricky and you need to learn the tricks.
Try to go to a name school, you are investing enough money not to go to a school that is not going to help you move a step ahead (through the name of the school or through the people you are going to meet). I have a friend that goes to a no-name school and they just accept anyone so the friends you make are definitely not that ambitious.
NOTE: the CEO of my company (6K employees) got his MBA at Wharton (he's a PhD as well) and he hired as CTO one of his friends from school.

I agree.. you should be suing the other party in front of you for injuries since they were the ones who stopped and as the person said - offense is the best defense .
If I remember correctly the first car in front of you had already collided with the car number 2 and hence all the accidents. I don't know how they can put you at fault . So let the lawyers handle it and go all the way .

Thanks for all the replies! I already contribute to IV, so all the mails about contributing to IV can stop :) You dont need to sell me IV.
I am considering an opportunity, but if I leave I might lose my PD as my current employer does withdraw the I140.

This is a great point. Even if we get one time relief,that should suffice because retro might not happen in the future as there will not be 245si/195kH1bs. I hope one of the core group members might want to look at this. This will atleast counteract the exaggerated and bloated immigration numbers by the antiimmigrant groups.
It is just speculation that it will take 10 years or 15 years. Actually past 3 years atleast 50% h1 were used by TCS,WIPRO and similar companies. So those who are processing gc is less. But it may take some time to clear current backlog as we had 195k H1 cap till 2003. If 65k h1 cap is there then it will be 3 year waiting period for EB2 and 4 to 5 year for Eb3. People will speculate based on number of H1s. But their calculation is not including the number of people who are giving up and also many people are going back. But if they increase H1 then the situation may become worse. I think one time releif will be enough to resolve the issue for
next 5 years. But Skil bill is asking too much(May be for permanent resolution of
gc issue) and opposition is more as anti immigrants are quoting the numbers. Remember in 2000 the relief of recapturing previous few years did not attract

Well Said! I support you 100% and agree with you totally about this. Fraud is any program is unfair and unjust on everybody, including the H1 holders themselves.
Actually, not all he said was wrong.
We should not support what these IT consulting companies are doing with H1B programme just because we are on H1. These big companies are hoarding H1B visas so they can have an upperhand when dealing with the employees.
My own employer was trying to get as many H1s as possible without having ANY work for them. They sent us all a few emails asking us if we had any family or friends back home who want to come to US on H1. These guys make the H1 applicants pay for the application expenses, then just keep them there or get them here and keep them on bench and almost everybody here is familiar with what happens next.
Think from an American's point of view.. It is THEIR country, THEY make the laws that benefit their society and economy.. they have all the right to stand up against these practices by foreign based companies..
I like his statement "H1B is supposed to be used when there IS a job but no American to do it" What these Consulting companies have turned it into is "There is a person on H1B avaliable If and when there is a job to do" OR worse "There is an H1B holder available, on bench, but no job to do"

With different employer, you can get 3 years as well, if the new employer has filed for a new PERM and you have received an approved I-140.
that is logical, but I am asking if I transfer now, which will be a simple H1B transfer - would I get only 6 months.
I actually received 3 years extension 2 weeks back with same employer, but considering another offer.
From what you said, it looks like the new employer can not get 3 years extension.:(

We the H1Bs are the victims of the this system. We did not create this system. It is true that there are social costs associated with this system. Abolishing the system is not the solution. Reform and making the system just is the solution..That is all we are asking for....
Blaming the victim of an atrocity for the atrocity is sheer stupidity....
Remember for Every Google, there is a ENRON. So based on ENRON experience you dont generalize all American Corps are dishonest.
Same logic applies here i work for a Small "Desi" Company and they are very honest and pay me reasonably well. They dont break laws or find ways to circumvent it. So i dont like to hear all H1Bs Companies are Cheats.

This is what my attorney told me:
4 Year Bachelors in India + 5 years of Exp (excluding sponsoring emp)
3 Year Bachelors in India + 2 Yrs(Msc) /3 Years(MCA) + 5 years of Exp (excluding sponsoring emp)
4 Year Bachelors in India + US Masters + 2 years of Exp (excluding sponsoring emp)
All these qualify for EB2. Just make sure you Job Description requires eb2.
Also, consult with a leading attorney and show you employer, that this is doable.
