One important issue is over looked here. Small employers will have a tough time in proving I-140 "ability to pay" for employees with older PD�s, whose labor got cleared after Aug 17 from BEC. Cuz the company has to prove its "ability to pay" the proffered wage starting from the date PD is established continuing until the adjudication of I-140.
Suppose the PD for an employee is Oct 2001 and the proffered wage is 80K per annum, then the company should prove that its assets, net income or salary payments were >=80K starting from Oct2001 continuing until the adjudication of I-140.
This is indeed an acid test for small employers.

I am not totally sure but this is how my husband earns his pdus..he is a volunteer in the local PMI chapter and he also presents some Project management papers. Also the local Chapter will have some monthly meetings or networking meetings where you can earn PDUs. He is also teaching PMI classes through the chapter. All these without any costs. So find a local chapter in your city and that should help you.

I am not sure either way, however I have heard the FBI comment that they only flag a small fraction of cases. IF that is true, then the USCIS may just be using the FBI as an excuse.

Well according to NSC they have completed processing of I485s upto Aug 2006 RD. They take only one year (and often less) to process I485s.
Pending I485s with earlier RDs are due to two reasons 1) retrogression and/or 2) FBI namecheck incomplete.
However, restrogression cannot cause wasted annual visa numbers. But FBI delays does. I doubt USCIS is passing the buck to FBI. It is a fact.
If USCIS wastes about 10K-20K visa numbers every year, then they are wasting about 10% every year. This 10% is consistent with the amount FBI name-check backlogs.

Only a regular Lou Dobbs watcher will know, Lou never read a negative message posted by audiance on his show, and he will read only those messages who are racist, and literally hates immigrants.
My experience is sending messages to the person whom we are going to target won't help. We need to counter attack using a different and equally powerful channel. The negative comments we post on Lou Dobbs and CNN are never posted or maybe never read to the end.

Lawmakers decide to bring an issue for consideration and then vote on the bill. Immigration issues usually start in the immigration sub-committee, then go to Judiciary committee and are finally voted by all members. There are 535 lawmakers (100 Senators + 435 House members).

This whole GC system is so unfavorably tilted and discriminatory towards Indians its unbelievable.
I also think its very unfair. I being EB3 India with PD of August 2001 is stuck whereas someone in my same category who is EB3 World who filed 2 yrs later than me is now elig to get greencard.

They worked enough for this year and they have lot to do. According to my guess they have the following pending work.
1. Issue Receipts (Sep/October)
2. Issue EAD cards for approx 300,000 applicants? (October/November/December)
3. Issues AP for 300,000 (October/November/December)
On top of this they need to celebrate thanksgiving and christmas like every citizen. So don't expect too much from them for this year.
If at all there is some momement in EB numbers, that will happen only between Jan-March(before H1-B madness starts).

People with '01/'02 PD's getting GCs before the rest is a bad thing because .....?
One minor side effect is that India EB dates might further retrogress because still there a lot of folks with PD 2001,2002 etc pending namecheck clearance.

We have shown the CA (Chartered Accountncy) equivalent to both a US bachelor's degree and a US Masters degree with an expert opinion letter. As far as I know they have all been approved. We have detailed research and we suggest the attorney cite it in the brief as well because that makes the case even stronger than just citing it in an evaluation or expert opinion letter.

You are the first guy whose case was transferred to CSC and you got the FP notices. Can you shed more light as many pople, like me, are stuck with no FP notices and we all had Receipts/EAD/AP from CSC...And now the files are back to either NSC or TSC...

Contact attoreny ASAP why/how it has happened. As he represnts you, USCIS acts upon his request to withdraw. However, he has to make such requsest only upon your written communication to withdraw the application. Therefore, find out whose mistake it is (law firm or USCIS).

- I have a letter I wrote to the attorney asking them to withdraw the representation. and the letter clearly states that.
- I have a copy of the letter the attorney sent to USCIS and this letter is clearly asking USCIS to withdraw the case.
The error is with the Attorney and it is one of the big immigration firms.
What really bothers me is that the error is not on USCIS's part but the error is of the Attorney so I am afraid that USCIS may not be too inclined to reinstate the case.
Does any one know if the client has any legal protection from errors and mistakes made by the attorneys
