Received one today.
Weirdest thing:
Person's 140 was revoked by employer;
person received notice of intent to deny. NOID clearly stated that 140 was revoked by employer then quoted ac21 law and said beneficiary may be eligible and to give job offer letter.
person responded with letter from new ac21 employer with perfectly matching job duties/descriptions.
uscis sent denial. Denial only stated that 140 was revoked and 140 immigrant petition is needed to get greencard.
Don't know if this is a new procedure that they are following the main law where a valied 140 is needed the whole time.
So do you think they are going after AC21 folks as a scapegoat? I spoke to few people on this including lawyers and they say that "denials on 485" when 140 gets revoked is a common thing and usually the officer who issues the denial letter does not check and verify to see other details. Thats why they have to go through the MTR process.

I was transferred to a IO yesterday. She was rude, told me that I should not be calling since they responsed to the first SR that was opened by my attorney on 09/01.
Not sure if you read the other thread, but I have got 2 responses from USCIS so far - one for inquiry that was sent when I took the Infopass and the other one that was opened by my attorney.
Response that I got for inquiry from my Infopass was " Based on the additional documentation provided, your case qualifies for expedited processing. You should hear back from us in 60 days. If you do not hear back in 60 days, please call us back".

Actually, not all he said was wrong.
We should not support what these IT consulting companies are doing with H1B programme just because we are on H1. These big companies are hoarding H1B visas so they can have an upperhand when dealing with the employees.
My own employer was trying to get as many H1s as possible without having ANY work for them.
This is also due to the fact that because even they have no work for all the H1B employees, they file for H1Bs in bulk, for they know that they don't have to pay people on bench, even though by law they are supposed to...
But most importantly we are concerned with visa recapture and GC reform in the long run..If H1B reform is the step towards that goal then that would be good..

It seems like different people have different experiences with different kinds of insurances. So it is almost clear that these insurance can act good or bad case by case basis depending upon their policies.

we took ICICILombard in india itself. My father has to see the doctor for
a small procedure done on this toe. He developed because of injury as he is diabetic.
And after reading so many negative reviews i was afraid whether i will get my 1200$ claim accepted or not. As i thought diabetes is a pre-existing condition.
And we also mentioned it in the insurance policy when we took.
But surprisingly we got the claim approved by ICICI Lombard last week and we got all the money (minus 100$ deductible).
So it's better to have some kind of insurance (to be on safe side) if you think the patriot and KV Rao are expensive.

$50 is too high. I know big communication American company who bring people here on $35 per day. That is even below the minimum wages.

Someone announces his 'greatest achievement' ... others challenge him to show true patriotism... yet others ask him to continue supporting India etc., AND this chap actually responds :)!
Wow! Seriously we all have too much time on our hands to be self promoting / congratulating / reminiscing etc...
Glad that this person will call US Senators etc., lets thank him for that and keep moving... instead of grilling him on things that matter to you! He owes you all no explanations or apologies.

...Frankly, all I can do is register my disappointment at both your response and your attitude.While I get it that IV is actively involved in doing things over the years aimed at resolving this issue, I might feel that I could respect and maybe even understand these efforts better if IV kept its website up to date and all members who sign in updated on what's happening.

USCIS is not dumb...They have interpreted the law in the way they think is appropriate....They are applying the over all 7% country cap to China/India EB2 and sending the overflow to EB3 ROW..... It is not fair but it is not exactly illegal...The law is open to interpretation and USCIS has chose to select this interpretation......You can take a crack at suing the USCIS.....I doubt that you would get anywhere......The EB2 India/China might benefit from the lawsuit....But as you know not all members would agree on IV spending resources on this lawsuit because this serves only a small section of member population.... At a personal level you can gather a few EB2 China India guys and have a crack at suing USCIS....

Based on my understanding once 485 is filed, one can only get one year H1b extension it does not matter if one uses EAD/AP.
i thought it had to do with visa numbers being unavailable rather than 485 filing

We need to try different ways to contact the law makers and find out which one is easy to implement and works efficiently.
When you call the law makers and tell them you support XYZ bill.. my question is what do you get out of it!

what is the motivation for the law maker to support the bill�
So to avoid sounding stupid and foolish and desperate when you call� a more logical approach would be to :
a) Generate a public petition form on IV website and have all the members� login and sign the forms digitally�
b) Then have IV reps.. fax them and send them to lobby groups �.
c) Lawmakers will listen to one talking head�and not worry abt 1000 calls that borders on ..�saar �support the bill saar�..
